At the time it was introduced, andragogy did offer benefits over “chalk and talk;” where most law students passively took notes while one student at a time actively engaged with their professor in a Socratic dialogue. While andragogy has sustained several modifications and revisions over the last fifty years, it does not reflect the life stage or life experiences that blur the boundaries of childhood and adulthood for over half the current student body in most law schools. What Did They Know And When Did They Know It? Pretesting As A Means Setting A Baseline For Assessing Learning Outcomes, Jeffrey L. Harrison

Are legal rules intuitive or, at least, consistent with common sense? In this study, 260 law students at five law schools who had not taken contract law, were presented with eight questions based on specific contracts cases or common contracts issues. They were asked what they felt was the fair or right answer to each question and to formulate the rule they would apply. The purposes of the study were to 1) determine whether contract law is what the untrained person believes it is or should be and 2) experiment with a strategy of pretesting to determine what topics within …

University of Baltimore Law librarians do not have a formal role in teaching legal research, but are frequent guest lecturers and recognized research experts. As such, we volunteered to administer UB's first summative assessment in accordance with the recent implementation of ABA Standard 314. This poster shows the steps taken to design, execute, and grade this legal research assessment, as well as how we reported the results to stakeholders.
The assessment had an objective true/false and multiple-choice section, and a subjective essay question. The librarians selected objective questions considering the core legal research competencies identified by RIPS-SIS following the MacCrate …

In 2007, two very influential institutes published reports that challenged legal educators to reconsider how they design courses, deliver instruction, assess their students’ learning and explore new ways to prepare students for the profession of law. The Carnegie Foundation for the Advancement of Teaching published its report, Educating Lawyers: Preparation for the Profession of Law (“Carnegie Report”), and the Clinical Legal Education Association published its study, Best Practices for Legal Education (“Best Practices Report”) (collectively, the “Reports”). Both Reports came to the same conclusion: law schools must devote more attention and resources to helping students develop the professional skills …

This article analyzes recommendations in the Rethinking Negotiation Teaching (RNT) series. Instructors teaching negotiation and other dispute resolution subjects have long had a hard time trying to cover everything they would like in their courses. The RNT project has documented (and, to some extent, stimulated) a growing profusion of ideas and techniques for teaching negotiation, which has multiplied instructors’ dilemmas in designing their courses. Since instructors cannot teach everything they would like, this article suggests some general principles for making decisions about what to include and how to conduct these courses. Legal research instructors seek to provide their students with a working knowledge of important research tools, strategies with which to develop a rational research plan, and the skill to conduct research efficiently, among other things. A well-conceived legal research class may utilize short-answer assignments, quizzes, and scavenger hunt exercises as a means to establish a baseline of knowledge with critical sources; a series of research problems, with grading based upon students' ability to describe a coherent and logical progression; and a pathfinder or process-oriented final exam, all depending on the instructor's goals. I do see hybrid teaching as the ASP model of the future. It is not a method that will be adopted by all schools, and it will certainly take time, and analysis, to refine the model to fit the student and school culture. Success is always a work in progress, but can only be achieved once you step from your comfort zone and try a new method.

It seems like more and more people today are selecting their legal research results based on ease of access rather than the completeness of the results. After hearing one too many third-year law students say "I researched my entire paper on Google," I set off to create a tool that would satisfy both the desire for speed and the need for complete and authoritative research results. The tool is a legal research toolbar that integrates into a web browser and provides constant and quick access to library-sanctioned websites and databases. In his essay, The 'Ideograph: A Link Between Rhetoric and Ideology', Michael Calvin McGee proposes that our system of beliefs is shaped through and expressed by words. We are consciously and unconsciously conditioned and controlled by the words we hear and use. Words carry ideology and convey and create meaning. Like Chinese characters, words are 'ideographs that 'signify' and 'contain' a unique ideological commitment', that is frequently unquestioned. McGee also suggests that by understanding that a single word can carry ideology and that ideology can be expressed in a single word, we are better able to expose and evaluate ideology …

The paper (I) outlines the nature and extent of the dissatisfaction with legal research instruction and demonstrates that the problem predates computer-assisted legal research, (II) presents the history of the debate (focusing on a heated exchange between advocates of a "process-oriented" approach and proponents of the traditional, "bibliographic" methods), and (III) presents the requisite elements of a satisfactory pedagogical model, discussing various issues surrounding each of these elements.

Wittgenstein wrote nothing on legal theory or law, so there is no obvious textual basis on which to draw possible connections between Wittgenstein and legal theory. And Wittgenstein abhorred theorizing in philosophy. So the odds are slim that Wittgenstein would have accommodated himself or his work to similar activity in the law. Where does this leave us?
At sea, which is where we normally are in life and, thus, where Wittgenstein wants us to recognize ourselves as being when doing philosophy too. But theory can disguise this fact from us, as it also can make us think that we have …
