The Role Of Innocence Commissions: Error Discovery, Systemic Reform Or Both?, Kent Roach
Chicago-Kent Law Review
This article examines the role of innocence commissions as emerging criminal justice institutions. It draws a distinction between commissions devoted to the correction of errors in individual cases and commissions which make systemic reform recommendations in an effort to prevent wrongful convictions in future cases. The British and Scottish Criminal Cases Review Commission and the North Carolina Innocence Inquiry Commission are examined as examples of the former type of commission while Canadian public inquiries and commissions in Illinois, California and Virginia are examined as examples of the latter type of commission. Adolf Hitler and the Nazis looted thousands of works of art throughout World War II. After the war, many pieces were not returned to the rightful owners but instead remained in public and private collections throughout the United States and abroad. California enacted California Code of Civil Procedure Section 354.3 in response to difficulties encountered by plaintiffs seeking to recover these pieces. The statute created a forum in California courts for plaintiffs to bring claims as rightful owners of Holocaust-era artwork. The Ninth Circuit recently found that this statute was preempted by the federal government’s exclusive power to conduct foreign …

In 2008, a San Diego trial court slapped Starbucks Corporation with a $100 million judgment for violation of California's tip-sharing laws. Shift supervisors, classified as “agents” of the employer by statute, could not share in tip jar proceeds, despite spending 95% of their time performing the same duties as ordinary Starbucks baristas. More recently, the Court of Appeal reversed the judgment, reasoning that tips placed in a tip jar are not personally given to or intended for baristas, and so are outside of the statute's reach. While strong evidence suggests Starbucks supervisors should be allowed a share of the tips, …

Heinous, Atrocious, And Cruel: Apprendi, Indeterminate Sentencing, And The Meaning Of Punishment, W. David Ball

Under Apprendi v. New Jersey, any fact that increases an offender's maximum punishment must be found by a jury beyond a reasonable doubt. The Apprendi literature has focused on the allocation of power between judge and jury, ignoring entirely the role of the parole board in indeterminate sentences-that is, sentences which terminate in discretionary parole release. In an indeterminate sentence, a judge makes a pronouncement about the length of the prescriptive sentence to be imposed, but the parole board decides the actual sentence that is, in fact, imposed.

California’s Sexually Violent Predator Act (SVPA) incorporates punitive and rehabilitative elements which split control over Sexually Violent Predators between medial and judicial institutions. These institutions struggle to control and define the rehabilitation of individual offenders. As a result, the implementation of the SVPA is fundamentally flawed. This paper argues: 1) sex offenders are treated as both culpable and sick, which impairs their rehabilitation; 2) the SVPA incorporates both determinative and indeterminate incarceration, which runs contrary to the basic foundation of the American legal system; 3) the struggle between medical and judicial elements has played out in the public forum, which …

This proposal takes a long view to revenue reform. It seeks to fundamentally align the sales tax with the digital foundation of the 21st Century economy.
The core policy question is whether California is willing to change the way it defines sales tax exemptions; is it willing to move from product-centric to person-centric exemptions. Certified tax determination systems can be relied upon. A key element in this proposal is the encryption of exemption certificates in IDs (smart cards with biometric identifiers that will allow the poor or handicapped to make certain purchases tax free).

California has not uncovered a single instance of technology-assisted cash skimming - there are no zappers, and no phantomware in California. Is this because Californians are not skimming cash sales with technology, or is this because the California technology works so well that the fraud cannot be detected?
The record in foreign jurisdictions is reasonable clear. Automated sales suppression technology is widely used to skim cash sales, denying the state revenues from consumption taxes that have been paid by the consumer, reducing taxable business profits, and funding a cash hoard out of which unreported employee wages are paid. This Essay analyzes local climate regulation in San Bernardino County as a window into the complexities of defining a local scale in an interconnected world. In so doing, it aims to contribute to the Symposium's broader dialogue about "Territory Without Boundaries" and the Panel's more specific discussion of "Urban Territory in a Global World." As a purely territorial matter, U.S. cities and counties differ substantially in their sizes, the quantity and physical characteristics of their land, the size and density of their populations, and the needs of their citizens. The California Global Warming Solutions Act of 2006 (AB 32) commits California to reduce its greenhouse gas (GHG) emissions to 1990 levels by 2020. The transportation sector is the top GHG emitter in California, contributing roughly 40 percent of all California emissions. Poor fuel efficiency and high vehicle miles traveled (VMT) are primary contributors to transportation sector GHG emissions. Meeting California’s GHG emissions reduction goals requires reductions in both per-mile emissions and vehicle miles traveled. Fuel efficiency has been addressed historically by federal Corporate Average Fuel Economy (CAFE) standards, and California has passed its own legislation regulating GHG emissions from …

In much of the American West water shortages are becoming an important concern. With increasing demands for water for municipal, industrial, and environmental uses, transfers of water from the currently predominant agricultural uses to these other uses should produce economic gains. Even though most commodity markets respond rapidly to price differentials and reduce those differentials over time, water transfers out of agriculture into higher value uses are not occurring very rapidly. The existence of multiple rights of exclusion unbundled from the rights of use under the prior appropriation doctrine in the American West creates an anticommons that has impeded water …

Despite spending more than any other state on its implementation and administration, California today is saddled with a death penalty law that can be described only as completely dysfunctional. We have the longest death row in America, with approximately 670 inmates awaiting execution. Typically, the lapse of time between sentence and execution is twenty-five years, twice the national average, and is growing wider each year. One hundred nineteen inmates have spent more than twenty years on California's death row. Most of them will certainly die before they are ever executed. Sustainable development is an international challenge that demands attention at all levels of government. The calls to action to achieve sustainability have varied over the last few decades. For example, in the 1970s and 1980s attention was focused on the need for environmental review and growth management strategies. In the 1990s the rhetoric shifted to smart growth and livable communities, and today, the issue has been reframed as advocates view sustainability through the lens of global warming and climate change. Regardless of the nomenclature, however, the end game is the same. While the United States as a whole speaks through …
