Land Trusts: An Alternative Method Of Preserving Open Space, Randee G. Fenner

In an effort to provide the background necessary to maximize the land trust's potential, this Article undertakes a three-part analysis, focusing on (1) the steps necessary to organize the land trust; (2) the techniques that may be used to accomplish the transfer of property to the land trust; and (3) the tax consequences associated with the land trust's conservation activities-consequences that may dictate the form that the transfer will take and upon which the success or failure of the preservation effort may hinge.

This article is about the Forest Hills new community development of the Nova Scotia Housing Commission. In examining this development, it is intended to explain its significance in the context of planning in general, community planning in particular, and planned unit development specifically. But first, some background seems appropriate. There exists a definition of "planning" as simply the thinking that precedes action.1 If this broad view is accepted, then virtually all human activity constitutes planning, right down to such insignificant decisions as which sock to put on first when dressing. Legislative Clarification Of The Correlative Rights Of Surface And Mineral Owners, J. Stephen Dycus

This Article examines the development of the judge-made doctrine of the dominant mineral owner, then considers the various legislative efforts to restrict or clarify the application of that doctrine. With this background it then proposes a new, more comprehensive statutory solution, which requires a clear expression of understanding about the effect of any mining activity upon the surface of the land. Constitutional implications of the different statutory schemes are identified and briefly discussed at the end of the Article.

This paper examines the effects and implications of the ‘public use’ requirement for the exercise of eminent domain in the United States. It is part of an ongoing inquiry the consequences of eminent domain in the United States. The first part examines the history of the public use requirement, both how the doctrine has been articulated and logically extended and what purposes have been accomplished under it. The second part of the paper is an analytic critique of the public use doctrine. After considering whether any principled standard can be developed to delimit the proper uses of eminent domain, it …

This collection consists of seven nineteenth century documents, including: An 1830 account of goods sold. The two parties are P. Beirne & Co. (spelling uncertain) and Benjamin Lemasters, and it is unclear of who is selling goods to whom. Survey of Lemasters’ plot of 1135 acres in Greenbrier County, West Virginia. The same mylar enclosure includes another copy of a survey from 1788 for Henry Banks. Letter dated 1835 form the War Department’s Pension Office to Lemasters relating to his service in the Revolutionary War.
