Uberregulation Without Economics: The World Trade Organization's Decision In The U.S.-Mexico Arbitration On Telecommunications Services, General Agreement On Trade In Services, Gats, J. Gregory Sidak, Hal J. Singer

In April 2004, a World Trade Organization ("WTO") arbitration panel found that Mexico had violated its commitments under the Annex on Telecommunications to the General Agreement on Trade in Services ("GATS") by failing to ensure that Telmex, Mexico's largest supplier of basic telecommunications services, provide interconnection to U.S. telecommunications carriers at international settlement rates that were costoriented. The WTO panel deemed long run average incremental cost ("LRAIC") to be the appropriate cost standard for setting settlement rates. Mexico thus became obliged to change its domestic telecommunications regulations or face trade sanctions. The decision is the first WTO arbitration to deal …

Cambodia's Wto Accession: A Strenuous But Necessary Step For A Poor Nation Seeking Economic Prosperity, Rebecca Povarchuk

During the 2003 World Trade Organization ("WTO") Ministerial Conference, Cambodia became the first least-developed nation to accede to the WTO through the organization's full working party accession process. Due to domestic, political, and economic pressures to accede, Cambodia agreed to an arduous package of legal and economic reform that have left many, including Cambodian officials, wondering whether the small country is capable of meeting its obligations. Having plunged into the WTO with the belief that accession is its best hope for a prosperous future, Cambodia now faces the challenges of implementation. The New Partnership For Africa's Development: Institutional And Legal Challenges Of Investment Promotion, Victor Mosoti

This paper is divided into five parts. Part I introduces NEPAD, its philosophical basis and objectives. Part II discusses the investment promotion role of NEPAD and its difference from past development thinking about Africa's problems. In Part III we discuss NEPAD's strategy for realizing investment flows into Africa, some of the NEPAD's institutional weaknesses, and the repercussions thereof in realizing the NEPAD objectives. It also highlights the potential implications of NEPAD to the regional integration plan in Africa. On August 30, 2002, the final decision was released in the case of United States-Tax Treatment for "Foreign Sales Corporations". The World Trade Organization arbitration panel report authorizes the European Communities to levy $4.043 billion in annual trade sanctions against imports from the United States because of a provision in the U.S. tax code. "The FSC Repeal and Extraterritorial Income Exclusion Act of 2000", the most recent of 40 years worth of half-hearted attempts by the United States to comply with world trading body regulations, is the current offender. Catfish Wars: Vietnam's Fight For Free Trade In The U.S. Court Of International Trade, Amalia R. Walton

Since the end of the Vietnam War, relations between the United States and Vietnam have been largely based on trade, causing both cooperation and conflict. Beginning in the 1990s, economic exchange between the two nations was encouraged through the 1994 lifting of the post-war trade embargo, the 1998 waiver of the Jackson-Vanik Amendment, and the signing of the U.S.-Vietnam Bilateral Trade Agreement in 2000. Vietnam's successful catfish industry was born of this cooperation but, soon after the U.S.-Vietnam Bilateral Trade Agreement went into effect, became the source of international controversy.
