The Quest For World Order: The Legacy Of Optimism Re-Examined, Richard A. Falk Nov 1984

The Quest For World Order: The Legacy Of Optimism Re-Examined, Richard A. Falk

Dalhousie Law Journal

President MacKay, ladies and gentlemen, it is a great honour for me to be here as a Killam lecturer. Let me start by telling a story that illustrates the direction of what I want to say. A Frenchman, an American and a Jew were all suffering from an incurable disease. They were told by a doctor that they had three weeks to live and each was asked what he would like to do. True to stereotype, the Frenchman said that he would take his mistress to the country and dine every night at a three-star restaurant. The American said that …

Federal State Clauses And The Conventions Of The Hague Conference On Private International Law, H. Allan Leal O.C., Q.C. May 1984

Federal State Clauses And The Conventions Of The Hague Conference On Private International Law, H. Allan Leal O.C., Q.C.

Dalhousie Law Journal

Dean Read would have been pleased, I believe, with this year's events since Canada has ratified The Hague Convention on the Civil Aspects of International Child Abduction.' This is a first for Canada in its participation in The Hague Conference on Private International Law. Dean Read worked hard and effectively to promote Canada's participation in that Conference and he was the Atlantic regional representative on the Canadian delegation to the first plenary session attended by Canadian delegates in 1968. I had the honour to work with him at that time and to be closely associated with him for many years …

Two Ideas Of International Organization, John H. Barton May 1984

Two Ideas Of International Organization, John H. Barton

Michigan Law Review

Political theory has long sought a philosophical basis for such ideas as law, authority, and freedom - but usually within the context of the nationstate. Only rarely has political theory placed the nation-state in an international framework; and, when it has tried, it has often done poorly. Sometimes the political theory becomes purely altruistic and utopian; at other times it works to support the irresponsibility of individual governments and the breakup of international order.

The Right Of States To Use Armed Force, Oscar Schachter May 1984

The Right Of States To Use Armed Force, Oscar Schachter

Michigan Law Review

When the United Nations (UN) Charter was adopted, it was generally considered to have outlawed war. States accepted the obligation to settle all disputes by peaceful means and to refrain from the use or threat of use of force in their international relations. Only two exceptions were expressly allowed: force used in self-defense when an armed attack occurs, and armed action authorized by the UN Security Council as an enforcement measure. These provisions were seen by most observers as the heart of the Charter. and the most important principles of contemporary international law. They have been reaffirmed over and over …

The Consolidated Treaty Series, 1648-1918, Ted L. Mcdorman

Dalhousie Law Journal

The Consolidated Treaty Series was a twelve year publishing project undertaken by the distinguished Cambridge international law professor Dr. Clive Parry. The treaty series contains reprints and translations of over 10,000 treaties signed between 1648, the establishment of the modem European state system, and 1919 when the League of Nations Treaty Series, the first official international collection, commenced publication. Each treaty is reproduced in its original language accompanied by French or English translations where such exist. Where a translation does not exist a summary of the contents of the treaty is included. Most importantly the source from which the treaty …

International Law As Law In The United States, Louis Henkin May 1984

International Law As Law In The United States, Louis Henkin

Michigan Law Review

"International law is part of our law." Justice Gray's much-quoted pronouncement in The Paquete Habana was neither new nor controversial when made in 1900, since he was merely restating what had been established principle for the fathers of American jurisprudence and for their British legal ancestors. And Gray's dictum remains unquestioned today. But, after more than two hundred years in our jurisprudence, the import of that principle is still uncertain and disputed. How did, and how does, international law become part of our law? What does it mean that international law is a part of our law? What is the …

The Crisis In Arms Control, Harold K. Jacobson May 1984

The Crisis In Arms Control, Harold K. Jacobson

Michigan Law Review

There is general agreement among observers of contemporary international affairs, and national and international officials from all sides, that there is a serious crisis in arms control. As of January 1984, the Soviet Union had broken off two major arms control negotiations: the Intermediate- Range Nuclear Force Talks (INF) and the Strategic Arms Reduction Talks (START). Negotiations in the United Nations Conference on Disarmament (CD) on a variety of arms control issues were stalemated. The United States was engaged in a large-scale military build up, and there was no sign that the Soviet Union would abate the extensive military programs …
