Administrative detention in any form curtails civil liberties. Yet the vast majority of countries use administrative detention in times of perceived national emergency.' In an enduring state of crisis, Israel has enacted an administrative detention statute designed to safeguard the security of the state and the due process rights of detainees. This comment will examine preventive detention in Israel and the occupied territories in the context of Israeli and international law.2Administrative detention refers to the confinement of individuals by the executive branch of government for imperative security reasons.3 Such detention frequently involves more flexible rules of procedure, evidence, conviction, and …

Applying The International Law Of Sovereign Immunity To The States Of The Union, John M. Rogers

A state of the Union may preserve its immunity from suit in its own courts, and the Constitution restricts its amenability to suit in the federal courts. Yet in Nevada v. Hall the Supreme Court held that in a motor-vehicle accident case a state cannot claim a constitutional immunity from suit in the courts of a sister state. The Court indicated, however, that if a suit involved a defendant state's “capacity to fulfill its own sovereign responsibilities,” different constitutional considerations might control. In vigorous dissents Justices Blackmun and Rehnquist argued that the reasoning of the majority precluded even this possibility. …

Over twenty years ago, Horace Read said: "The first half of this century has seen the emergence of legislation as the chief instrument of change and innovation in the law".2 True though this comment was in 1959, it has received added force in the common law world, especially in the Commonwealth, by the 'explosion of law reform' 3 which has taken place since the mid-sixties. The creation of permanent statutory law reform agencies has tilted the balance even further towards legislation as the instrument of legal change. This is for two reasons. Mining The Deep Seabed Implications For International Law And American Foreign Policy, Steven H. Fitzgerald

Whether or not the United States may someday face a mineral shortage, the need for a coherent, unified minerals policy is critical to national objectives and national security. Deep-sea mining may be the answer to American (and world) mineral needs in the twenty-first century. However, there are numerous problems which must be dealt with and resolved in the near future, in order to enable the U.S. (and the world community) to take advantage of vast undersea resources. Deep-sea mining requires the development of technology, tremendous capital investments, and years of labor before production can begin. U.S. policy makers must decide …

The Transfer Of Technology To Latin America, Gabriel M. Wilner

The transfer of technology to Latin America has taken place through both the licensing process and direct investments by foreign enterprises that are often transnational corporations. National law has concerned itself first with the creation of rights in technological knowledge and the protection of these rights by law. The regulation of these rights as set out in contractual relationships and the regulation of direct investment, particularly the technological component thereof, were dealt with thereafter. Other matters such as the repatriation of profits (exchange control), customs controls, and various taxes have also become a part of the national regulatory scene today. …
