The Trial Of General Tomoyuki Yamashita: A Case Study In Command Responsibility, L. H. Redford

The case of General 'Tomoyuki Yamashita, the subject of this thesis, established a precedent in international law, at least so far as the United States respected that law, Its successful prosecution prepared the way for the prosecution of numerous, subsequent war crimes cases, upon a standard of liability developed and approved by the United States in Yamashita, and without regard for the attenuated procedural protections granted in American civil courts. General Mac-Arthur played an important part in Yamashita’s trial, and this essay shall also discuss the extent of his interest and involvement in the case.

International Treaty Law And The Domestic Law Of Canada, R. St. J. Macdonald

In this paper I propose to explore the relationship between treaty law and domestic law in Canada. I will start with the familiar theory of the relationship between treaties and domestic law in England and in Canada and then move to less familiar areas of Canadian practice. An attempt will be made to investigate the rather murky area surrounding interdepartmental arrangements between Canada and sovereign states which are less than treaties but which do affect domestic law. I will attempt to raise, if not to answer, preliminary questions about the effectiveness of these procedures, the safeguards inherent in them, and …

Some Aspects Of Quebec's Official Language Act, Yvonne W. Rosmarin

Syracuse Journal of International Law and Commerce

In July 1974, the legislature of Quebec passed an Official Language Act, declaring French to be the sole official language of the province. Although the majority of Quebec's population speaks French, there is a significant minority of English-speaking Canadians living in the province who will be affected. This Act, commonly known as Bill 22, will also affect businesses, particularly American corporations with subsidiaries operating in Quebec. Bill 22 has sparked a controversy in Canada with respect to both its constitutionality and the power of the Province of Quebec to pass such legislation.

All nations recognize the enormous problem of marine pollution. The sources of marine pollution are definable, and there are methods by which these sources may be restricted. Virtually all mankind would prefer less pollution to more. Prevention, however, becomes less attractive in light of its costs, which assume both political and economic characteristics. Varying political and economic climates coupled with problems of sovereignty and national self-interest render agreement on the imposition of standards difficult.
