Since this country was created, the insurance industry has been principally
regulated by the states with infrequent Congressional interventions.
As the insurance industry has evolved in recent decades, however, individual
states have become unable to adequately regulate some insurers, such
as multinational insurers and foreign insurers, because they lack jurisdiction
over such entities. Simply having the federal government assume responsibility
for regulating insurers will not solve the current regulatory
problems, however, because Congress’ past forays into regulating certain
areas of insurance generally have yielded poor results. Consequently, this

Many scholars argue that the international regulation of solar climate engineering should be developed within those existing legal institutions that have (near-) universal participation--such as those of the UNFCCC or the CBD--and often toward binding rules. I believe that it would be counterproductive, at least for the foreseeable future. It is presently not a relatively productive endeavour to dwell on how states might collectively govern technologies which do not yet exist; whose forms, benefits, risks, costs, and reversibilities remain unknown; and under what circumstances and for what purposes they might be used are likewise still indefinite. This paper analyzes several emerging transnational regulatory systems that engage, but are not centered on state legal systems. Driven primarily by civil society organizations, the new regulatory systems use conventional technical standard setting and certification techniques to establish market-leveraged, social and environmental regulatory programs. These programs resemble state regulatory programs in many important respects, and are increasingly legalized. Professor Buchanan begins her paper by questioning whether recent economic and political shifts towards notions of "globalization" (e.g., the NAFTA) have failed to consider the politics or economics of change in particular places. Her prime example of a "place" where integration is illogically forced against a background of differentiation is the U.S.-Mexico border region. This Article uses the jurisprudential dichotomy between two opposing types of legal requirements — “rules” and “standards” — to examine extraterritorial regulation by the United States. It argues that there is natural push toward standards in extraterritorial regulation because numerous institutional actors either see standards as the best option in extraterritorial regulation or accept standards as a second-best option when their first choice (a rule favorable to their interests or their worldview) is not feasible. The Neomercantilist Fallacy And The Contextual Reality Of The Foreign Corrupt Practices Act, Philip Nichols

The Foreign Corrupt Practices Act is domestic legislation and should be analyzed as such. This article addresses a persistent failure in analysis of the Act, by scholars and policymakers alike. Many discussions of the Act approach it from a neomercantilist perspective. This approach contains three flaws. First, whereas neomercantilism envisions manipulation of the market to give advantage to national champion industries, the Foreign Corrupt Practices Act was adopted for the purpose of strengthening and enhancing the integrity of the global market. Intentional interventions in global physical, chemical, and biological systems on a massive scale are receiving increasing attention in hopes of reducing the threat of anthropogenic climate change. Known as climate engineering, or geoengineering, research is moving forward, but regulation remains inadequate, due in part to significant regulatory challenges. This essay asserts that key to overcoming these regulatory challenges is distinguishing between the two primary forms of climate engineering, and between deployment and research.
