Agency Pragmatism In Addressing Law’S Failure: The Curious Case Of Federal “Deemed Approvals” Of Tribal-State Gaming Compacts, Kevin K. Washburn

In the Indian Gaming Regulatory Act of 1988 (IGRA), Congress imposed a decision-forcing mechanism on the Secretary of the Interior related to tribal-state compacts for Indian gaming. Congress authorized the Secretary to review such compacts and approve or disapprove each compact within forty-five days of submission. Under an unusual provision of law, however, if the Secretary fails to act within forty-five days, the compact is “deemed approved” by operation of law but only to the extent that it is lawful. In a curious development, this regime has been used in a different manner than Congress intended. Since the United States …

An Exploratory Study In To The Money Laundering Threats, Vulnerabilities, And Controls Within The Uk Bookmaker Sector, With A Specific Focus On Fixed-Odds Betting Terminals, Kane Pepi

The purpose of this exploratory study was to generate an understanding in to the money laundering threats, vulnerabilities and controls found within UK betting shops, with a direct focus on the exponential growth of Fixed-Odd Betting Terminals. Qualitative research methods facilitated eight semi-structured interviews with key stakeholders linked to the gambling and/or money laundering sphere. This included the Gambling Commission, Campaign for Fairer Gambling, an ex-Head of Security and Safety at a major bookmaker, and five regular Fixed-Odd Betting Terminal users. The interviews were recorded, transcribed and coded for thematic analysis, subsequently resulting in the emergence of four interesting and …

This note will set out to prove why PASPA is no longer effective and why reform is needed. With the state of New Jersey leading the fight, change is on the horizon. First, the history of gambling laws in the United States will be covered. Next, the legal and other supplemental arguments for and against PASPA will be discussed. The Court determined that application of NRS § 463.120(6), as enacted in 2017 through Senate Bill 376, which protects certain information and data provided to the gaming authorities, does not apply to information requested before the effective date of the statute. From the plain language of the act that the privilege applies to “any request made on or after the effective date of this act,” the Court concluded that the privilege applies prospectively only and does not apply to any request made before the effective date of this act.

Slave Gambling In The Antebellum South, Robert M. Jarvis

Florida A & M University Law Review

In the Antebellum Era (c. 1800-60), Southern slaves gambled regularly, both with each other and with free blacks and poor whites. This fact has received a fair amount of scholarly attention. Curiously, however, the reported court opinions involving such gambling have been all but overlooked. Accordingly, this article collects and discusses these decisions. As will be seen, Southern judges often were exasperated by the less-than-precise wording of the laws that were put in place to punish slaves who gambled and whites who facilitated or participated in such gambling.
