The Indonesian Marriage Law states that marriage is a physical and spiritual relationship between a man and a woman as husband and wife in order to create an eternal happy family based on the Almighty God. This paper describes the intervention of customary law in the resolution of cases of violence against women and children - especially the intervention that is considered to be able to give justice to the victims. Settlement cases selected by the families of the victims of the indigenous peoples are not limited to cases which are brought to the formal judicial forum. Non-formal mechanisms (through elders) often provide resolution forums.
