With nearly half of all first time marriages ending in divorce, there is no wonder that legal reform in the area of domestic relations law has recently taken the State of New York by storm. New York held onto the relic of fault-based divorce for an unusually long period of time, in part due to notions of marital sanctity and reinforcement of the traditional nuclear family. On the other hand, the State, after succumbing to the battle over no-fault divorce, quickly adopted a progressive social and legislative policy by validating the desire of same-sex couples to marry.

On November 1, 2008, the New York State Bar Association House of Delegates approved a resolution affirming their commitment towards establishing a civil right to counsel in New York State. One of the issues identified is a child's right to representation not only in criminal, but also civil proceedings. Unlike other litigant groups, children have a statutorily established right to council in civil proceedings. However, as the white paper, adopted by the New State Bar Association, details, there are gaps in children 's advocacy throughout New York State. In 1996, the New York State Legislature attempted to afford additional protection to domestic violence victims and their children involved in custody disputes by amending New York's Domestic Relations Law and the Family Court Act to mandate consideration of domestic violence when determining the best interests of the child in custody and visitation cases. Four years later, it is evident that the amendment failed to change the behavior of the courts or overcome the entrenched attitudes of many judges, attorneys and forensic evaluators regarding domestic violence.
