The United States Supreme Court has raised the legal standard for a municipality to use land use exactions for sustainable development. Land use exactions frequent local government affairs and occur when a government demands a dedication of land or money in exchange for a municipal approval, such as a permit. Koontz v. St. Johns River Water Management District found certain proposed government exactions for land use permits as “demands” on the applicant and required a “‘nexus' and ‘rough proportionality’ between the property that the government demands and the social costs of the applicant's proposal,” regardless of whether the exaction was …

Unfortunately, Nigeria flares an estimated 2.5 million cubic feet of gas each day which amounts to almost 40 percent of the total gas consumed in Africa. A microgrid is an energy system specifically designed to meet some of the energy needs of a group of buildings, a campus, or an entire community. It can include local facilities that generate electricity, heating, and/or cooling; store energy; distribute the energy generated; and manage energy consumption intelligently and in real time. Microgrids enable economies of scale that facilitate local production of energy in ways that can advance cost reduction, sustainability, economic development, and resilience goals. As they often involve multiple stakeholders, and may encompass numerous distinct property boundaries, municipal involvement is often a key factor for successful implementation.

Sustainable development is a useful evaluative framework for shale gas development. The failure of international law and institutions to address global environmental degradation has significant implications for law and society as the planet’s ecosystems approach irreversible tipping points. According to a recent study published in the journal Science, the global economy has transgressed four of the nine “planetary boundaries” critical to the planet’s self-regulating capacity. Climate change, deforestation, species extinction, and the runoff of phosphorus and nitrogen into regional watersheds and oceans have exceeded safe biophysical thresholds.
