Georgia Goes Superfund: A Look At The New Georgia Hazardous Site Response Act, Robert D. Mowrey

The enactment in 1980 of the Federal Comprehensive Environmental Response, Compensation, and Liability Act ("CERCLA") is commonly attributed to the uproar surrounding the evacuation of the Love Canal neighborhood in Niagara Falls, New York. The discovery of thousands of buried drums containing hazardous waste on a Douglas County, Georgia horse farm known as Basket Creek might be considered Georgia's Love Canal, not because of any particular environmental similarities to the Niagara Falls site, but because of the similarities in legislative impact. Just as the publicity surrounding Love Canal gave sudden rise to CERCLA, Basket Creek provided the primary impetus to …

Causation In Fact In Omission Cases, David A. Fischer

Faculty Publications

This article analyzes the difficulties involved in attributing cause in fact in omission cases, and suggests possible resolutions. Part II discusses the basic concept of causation, and the distinction between acts and omissions. Part III discusses the particular problems that arise in applying causation principles in omission cases. Part IV then analyzes these problems from both corrective justice and economic analysis perspectives. Finally, the article suggests an approach for solving these complex issues.

The Public Trust Doctrine And Coastal Zone Management In Washington State, Ralph W. Johnson, Craighton Goeppele, David Jansen, Rachael Paschal

Washington Law Review

The public trust doctrine is an ancient doctrine that has recently emerged as a powerful tool to protect the public interest in tidelands and shorelands. Created and developed by the judiciary, the doctrine's principles have found their way into several of Washington's regulatory statutes, such as the Shoreline Management Act and the Aquatic Lands Act. This Article traces the development of the doctrine in Washington, and explains the relation between the state's police power and the public trust doctrine.
