Franchisor Environmental Liability For Previously Contaminated Property, Patrick J. Kaufmann, William S. Vincent
Franchisor Environmental Liability For Previously Contaminated Property, Patrick J. Kaufmann, William S. Vincent
Faculty and Research Publications
Environmental legislation has created potential liability for retailing franchisees that purchase previously contaminated land. Faced with a decision to distance itself from the site selection process or incur the added costs and potential pricing impacts of greater involvement in the process, franchisors have strong incentives to reduce franchisee support. This reduction in support has detrimental implications for both franchise policy and environmental policy. A paper reports the results of an empirical study that links franchisors' concerns about potential environmental liability to actions to distance themselves from the site selection process or, alternatively, formally to require franchisee environmental investigation of all …

Colorado River Basin Study. Report To The Western Water Policy Review Advisory Committee, Dale Pontius
Colorado River Basin Study. Report To The Western Water Policy Review Advisory Committee, Dale Pontius
Federal Documents
This report cannot possibly cover all the issues of concern in the Colorado River basin. The basin is vast and diverse geographically, ethnically, and politically. Conflicts over water are part of its history, as water has been the defining resource in the settlement and development of the Colorado River basin. A complex set of laws, a treaty, court decrees, contracts, agreements, regulations and traditions of use have evolved over this past century which have governed water policy and management decisions. Over the last few decades, new social values have emerged in the basin and across the country which reflect an …

Water Management Study: Upper Rio Grande Basin. Final Report. Report To The Western Water Policy Review Advisory Commission, Ernie Niemi, Tom Mcguckin
Federal Documents
In September, 1996, the Western Water Policy Review Advisory Commission contracted with ECONorthwest to study the major problems associated with the growing competition for scarce water and related resources in the Upper Rio Grande Basin, and to make recommendations for appropriate federal policies and actions for addressing the problems. This is our final report. The study covers the area from the headwaters, in Colorado, to Ft. Quitman, Texas (see map).
In this report we identify problems and make recommendations associated with the growing competition for scarce water and related resources in the Upper Rio Grande Basin. Our definition of problems …

The Case Of The Speluncean Polluters: Six Themes Of Environmental Law, Policy, And Ethics, J.B. Ruhl
The Case Of The Speluncean Polluters: Six Themes Of Environmental Law, Policy, And Ethics, J.B. Ruhl
Vanderbilt Law School Faculty Publications
Almost as soon as it was invented in the early 1970s, the United States' modern environmental law framework has been the subject of calls for reform. Six divergent reform approaches predominate that debate today, and behind each lies strongly held policy and ethical perspectives. Using the futuristic setting Lon Fuller created in his classic study of legal theory, The Case of the Speluncean Explorers, Professor J.B. Ruhl pits those environmental law approaches against each other as society finds itself on the day of reckoning for the environment in the year 4310 AD. The discovery many centuries earlier of a remarkable …
