Dustbowl Waters: Doctrinal And Legislative Solutions To Save The Ogallala Aquifer Before Both Time And Water Run Out, Warigia M. Bowman
Articles, Chapters in Books and Other Contributions to Scholarly Works
Eighty-three years after the Dust Bowl, residents of America’s High Plains face a dire threat: their primary aquifer faces depletion, and entire sections of the country are set to run out of groundwater by the end of the century or sooner. The Ogallala Aquifer provides a significant amount of America’s agricultural irrigation water and is a primary source of drinking water for Colorado, Kansas, Nebraska, New Mexico, Oklahoma, South Dakota, Texas, and Wyoming. This Article argues that policymakers should slow the Aquifer’s depletion rate by implementing changes to irrigation technology, crop choice, consumer behavior, legal doctrine, and legislation. A Tale Of Two Water Districts: The Future Of Agriculture In California's San Joaquin Valley Lies In Compromise Over Drainage, Kathleen Nitta
Golden Gate University Environmental Law Journal
This Comment will demonstrate why enforcement of the lower San Joaquin River total maximum daily load (TMDL) for selenium under the Clean Water Act should be postponed by amending the Basin Plan for the lower San Joaquin and Sacramento Rivers to extend the selenium compliance schedule for the Grassland Area Farmers (GAF) until it finishes implementing its drainage management plan. This Comment will also discuss why the GAF’s drainage plan should be used as a model for Westlands and should prompt Congress to amend the San Luis Act to require Westlands’ farmers to provide their own drainage.
Part II will …

Reaping Riches In A Wretched Region: Subsidized Industrial Farming And Its Link To Perpetual Poverty, Lloyd G. Carter
Reaping Riches In A Wretched Region: Subsidized Industrial Farming And Its Link To Perpetual Poverty, Lloyd G. Carter
Golden Gate University Environmental Law Journal
This Article shows how a long American tradition of helping small farmers has, in the past few decades, morphed into a massive government aid program for large industrialized agribusiness operations—a program that not only drives small farmers off the land but also perpetuates rural poverty because agribusiness requires huge numbers of low-paid, seasonal harvest workers, many of whom are undocumented workers who choose to stay in the United States. Part II reviews the history and evolution of publicly subsidized farming in the Valley. Part III discusses the creation of the Westlands irrigation district as representing the archetype of large "factories …

Western Water Law, Policy and Management: Ripples, Currents, and New Channels for Inquiry (Martz Summer Conference, June 3-5)
In many pockets of the American West, stresses and demands on water resources are overwhelming our capacity to effectively manage change and accommodate the diversity of interests and values associated with our limited water resources.
This event will offer an opportunity for lawyers, policymakers, and water professionals to engage the experts on the challenges and emerging solutions to the most pressing water policy and management issues of the day.
