The average American voter is apathetic, ignorant and polarized, or so we are told. Except, it turns out, with respect to her views on the outsized political influence of the super wealthy: poll after poll reveals a bipartisan consensus that wealthy interests exert too much political influence and there is good evidence to support these concerns. While the public blames the Supreme Court’s decision in Citizens United v. FEC for this situation, experts in the field know that the constitutional constraints on our ability to limit the political influence of moneyed elites long-predate Citizens United and pose a formidable barrier …

This article seeks to enhance public consideration of the pros and cons of streamlining California's informal-administrative-rulemaking procedures for reforming the state's direct democracy. To provide a concrete focus for discussion and quick adoption, Appendix I includes proposed amendments to existing California statutory provisions. This article provides a context for considering the proposed legislation by elaborating on five questions: Why Deliberation? Until 1913 and passage of the Seventeenth Amendment to the United States Constitution, US senators were elected by state legislatures, not directly by the people. Progressive Era reformers urged this revision in answer to the corruption of state "machines" under the dominance of party bosses. They also believed that direct elections would make the Senate more responsive to popular concerns regarding the concentrations of business, capital, and labor that in the industrial era gave rise to a growing sense of individual voicelessness. В статті робиться висновок про недоцільність виокремлення вузького та широкого значення дефініції "виборча система". Системний аналіз політико-правового явища - виборча система - обґрунтовує його авторське визначення. Автор зазначає, що виборча система - це політико-правовий інститут, який забезпечує реалізацію виборчих прав громадян, формування владних виборних органів та певний тип організації публічної влади через сукупність відносно самостійних, але взаємообумовлених та взаємодіючих в межах виборчого процесу, конституційно-правових технологій (способів, прийомів, методів, критеріїв) балотування кандидатів на виборні посади, голосування виборців, підрахунку голосів та встановлення результатів виборів.
