Luxury Markets, Antitrust, And Intellectual Property: An Introduction, Ben Kleinman-Green Oct 2008

Luxury Markets, Antitrust, And Intellectual Property: An Introduction, Ben Kleinman-Green

Ben Kleinman-Green

In this paper I look at markets for luxury goods and begin exploring the interplay among trademark law, antitrust law, luxury goods, and copies of luxuries. In the absence of empirical data and economic theories directly on point, I informally extend a model of luxury markets to account for copies of luxury goods and then look to trademark law cases for indications of how courts might evaluate luxury markets in an antitrust context.

Prosperity And Inequality: Lessons From The United States, Samuel L. Myers Jr Sep 2008

Prosperity And Inequality: Lessons From The United States, Samuel L. Myers Jr

Samuel L Myers Jr

For most of the post-World War II period prior to the 1980s, the distribution of income in the United States remained remarkably stable. Measures of inequality – such as the gap between incomes of those at the top and those at the bottom of the income distribution – showed little change for nearly 40 years (Darity and Myers, 1998, p. 3). In their book, Persistent Disparity, published 10 years ago, Darity and Myers documented a contemporaneous rise in general inequality and the widening of black-white disparities in family incomes. The ratio of black to white family incomes declined from the …

Space Settlements, Property Rights, And International Law: Could A Lunar Settlement Claim The Lunar Real Estate It Needs To Survive?, Alan Wasser, Douglas Jobes Jan 2008

Space Settlements, Property Rights, And International Law: Could A Lunar Settlement Claim The Lunar Real Estate It Needs To Survive?, Alan Wasser, Douglas Jobes

Alan Wasser

The settlement of space and the expansion of the habitat of humanity beyond Earth will benefit all mankind but will be astronomically expensive. Private enterprise would do it if there were a sufficient profit potential, something only Lunar and Martian real estate is valuable enough to provide. Utilization of this tremendous potential value as an incentive has been prevented by the mistaken assumption that the 1967 Outer Space Treaty's prohibition of "national appropriation" and requirement of national supervision of private activities prohibit private property in space. This paper attempts to demonstrate, by expert legal consensus, that the 1967 Outer Space …

Do R&D Programs Of Different Government Levels Overlap In The European Union?, Andrea Fernandez-Ribas, Isabel Busom Jan 2008

Do R&D Programs Of Different Government Levels Overlap In The European Union?, Andrea Fernandez-Ribas, Isabel Busom

Andrea Fernandez-Ribas

Multiple levels of government currently design and implement research and innovation programs both in the US and in Europe. Empirical analysis of interdependencies among programs has not been fully explored, however. Our contribution is a first step in understanding potential complementarities across R&D programs. Using a sample of Spanish manufacturing firms, we study the determinants of firms’ participation in national and in European level research programs and test for differences across programs. Our results suggest that firms’ participation in European and national R&D programs is largely driven by different factors. We interpret these results as suggesting that, ex-post, there is …

Climate Change And Freshwater Resources, Noah D. Hall, Bret B. Stuntz, Robert H. Abrams Jan 2008

Climate Change And Freshwater Resources, Noah D. Hall, Bret B. Stuntz, Robert H. Abrams

Noah D Hall

The Earth’s climate is warming. This is the unequivocal conclusion of climate scientists. Despite the complexities of climatology, certain consistent trends emerge with implications for water availability: as the world gets warmer, it will experience increased regional variability in precipitation, with more frequent heavy precipitation events and more susceptibility to drought. These simple facts will have a profound impact on freshwater resources throughout the United States, as the warmer climate will reduce available water supplies and increase water demand. Unfortunately, current water law and policy are not up to the new challenges of climate change and resulting pressures on freshwater …

Justice Versus Benevolence: A Modern Humean View, Mario J. Rizzo Jan 2008

Justice Versus Benevolence: A Modern Humean View, Mario J. Rizzo

Mario Rizzo

This paper is an attempt to "update" and extend David Hume's moral psychology by demonstrating its consistency with the findings of construal level theory as recently developed by Trope, Liberman and others. Following Hume, justice is an abstract virtue the practice of which which does not give the individual positive psychological feedback in all cases. A single act of justice may be perceived as contrary to the public or private interest. It often takes a cognitive act of abstract construal to see and to appreciate the value of justice. Beneficence, on the other hand, is a concrete virtue. Its psychological …

Political Liberalism And Public Reason, Mario Šilar Jan 2008

Political Liberalism And Public Reason, Mario Šilar

Mario Šilar

The paper explores John Rawls´s idea of public reason, as reflected in Political Liberalism and The Idea of Public Reason Revisited. In Rawls’s later works, public reason acquires fundamental significance as a criterion by which the principles to be assumed from the outset in a theory of political justice may be determined. The starting-point for Rawls´s theory -the idea of citizens as free and equal reveals- that this abstraction falls short of an authentic conception of human beings as social by nature. A brief study of key issues concerning marriage and the family shows the difficulties that underlie this question. …

Steering Tax On Children’S Tobacco Consumption, Michael Adams Jan 2008

Steering Tax On Children’S Tobacco Consumption, Michael Adams

Michael Adams

Careers of smokers almost always start in infancy. Therefore, the tobacco industry is confronted with the economic necessity to turn children into addicted smokers. Present efforts to reduce the smoking rate of children remain without sufficient effect, because they miss to change this incentive. The solution is to tax cigarettes smoked by children. Adequately designed this steering tax causes the industry to prevent children from smoking instead of turning them into addicted smokers.

When Eu Law Meets Arabic Law: Assessment Of Anti-Corruption Law In Morocco And Some Proposed Amendments, Bryane Michael, Abdelaziz Nouaydi Jan 2008

When Eu Law Meets Arabic Law: Assessment Of Anti-Corruption Law In Morocco And Some Proposed Amendments, Bryane Michael, Abdelaziz Nouaydi

Bryane Michael (bryane.michael@stcatz.ox.ac.uk)

This article reviews the present state of the adoption of anti-corruption legal provisions usually adopted in EU (or candidate) countries in Morocco. Morocco lags behind many countries in its adoption of anti-corruption legislation and the recently established Central Agency of the Prevention of Corruption is unlikely to succeed in speeding up the adoption of these measures. English language translations of a number of Moroccan anti-corruption legal instruments are presented and amendments to these legal instruments are recommended (based on international best practice) in order to increase the likely effectiveness of Moroccan law enforcement institutions in fighting corruption.
