This paper explores journalism as a potential method of conflict resolution. Part I compares the norms and practices of journalism to those of facilitative mediation. Part II draws additional parallels between some aspects of journalism and two other forms of dispute resolution: transformative mediation and adjudication. Part III suggests some areas for encouragement and some areas for caution as peace journalists import conflict resolution techniques into news reporting and writing.

Chief Judge Robert M. Bell has been a visionary leader in the development of alternative dispute resolution (“ADR”). His innovations have made Maryland a model state for conflict resolution programs in the courts and, uniquely, beyond the courthouse doors in a broad range of arenas. This article provides an overview of the “culture of conflict resolution” he ignited in the judiciary and in communities.

Participation Versus Procedures In Non-Union Dispute Resolution, Alexander Colvin

This study examines the resolution of conflict in non-union workplaces. Employee participation in workplace decision making and organizational dispute resolution procedures are two factors hypothesized to influence the outcomes of conflicts in the non-union workplace. The adoption of high involvement work systems is found to produce an organizational context in which both triggering events for conflict, such as disciplinary and dismissal decisions, and dispute resolution activities, such as grievance filing and appeals, are reduced in frequency. Zu den Faktoren, die in jüngster Zeit in mehreren Ländern – insbesondere in den USA – zu einem Rückgang der Mitgliederzahlen der Gewerkschaften geführt haben, zählen Strategien des Human Resource Managements wie „nonunion arbitration“ (gewerkschaftsfreies Schiedsverfahren“. Arbeitgeber in nicht tarif- und gewerkschaftsgebundenen Betrieben führen solche „neuen Verfahren der Konfliktschlichtung“ (NVK) mit dem Ziel ein, einen Teilersatz für die gewerkschaftliche Interessenvertretung zu gewähren. Employees in the Public Sector face a range of workplace conflicts from the “macro” to the “micro.” State and federal budget cutbacks can jeopardize programs, which can create conflicts with clients who no longer meet eligibility criteria and/or with coworkers whose positions are no longer funded. Increasing stress in and out of the workplace affects work and home life and employees across the spectrum need additional assistance managing the impact of these complicated issues. Employee Assistance Programs (EAPs) were designed as workplace benefit programs to provide services and training to help employees manage the issues most affecting their work.

Research has demonstrated the significant negative impact of ongoing inter-parental conflict on children (PR Amato, ‘The Consequences of Divorce for Adults and Children’ (2000) 62(4) Journal of Marriage and the Family 1269; B Rodgers and J Pryor, Divorce and separation: The outcomes for children (Joseph Rowntree Foundation, 1998); J Wallerstein and S Blakeslee, The unexpected legacy of divorce (Hyperion, 2000)). In addition to the harm they may be causing their children, ‘high conflict’ separated and divorced parents have frustrated attorneys and created additional workloads for the courts.
