This presentation provides an overview of Supreme Court caselaw regarding qualified immunity and government officials’ right to interlocutory appeal from denials of qualified immunity, and provides a brief discussion of ways trial lawyers can overcome interlocutory appeals to provide their injured plaintiffs with an opportunity to be heard and vindicated at trial by a jury.

“Open courts” are a bedrock principal of our judicial system, and court secrecy, including concealment of pretrial proceedings, poses a serious threat to public safety. Overbroad protective orders have concealed facts uncovered during litigation regarding some of the most important public harms, keeping them secret when the public needs protection. Protective orders routinely include provisions that allow parties to designate discovery material as “confidential” without further judicial review. These orders are often abused and result in unnecessary costs to litigants, the courts, and the public’s confidence in the court system. This is always a mistake because it harms the discovery …

The study aims at identifying the degree to which the use of modern educational technologies on the quality of education and its development in al-ahliyya Amman university from the viewpoint of faculty members by developing a questionnaire consisting of (20) items which were distributed to a random sample consisting of (198) faculty members. The results of the study showed that the most important modern technologies used in university education are: first, information network (the Internet) with a rate of (18.70%), and second, social networking sites, with a rate of (15.9%). The present study aims at exploring the prevalence of type D personality (distressed personality) and the levels of anxiety (trait) and depression in a sample of cardiac patients in comparison to their non-patient counterparts in Jordan. To achieve the objectives of the study, an adapted form of type D personality scale-DS14, Trait Anxiety Scale and Beck Inventory were utilized. Upon the arrival of European settlers in Canada, Indigenous legal traditions have continuously been undermined as customary law with an insignificant role in crime prevention and sanctioning. This paper will argue that Indigenous legal traditions deserve a larger role in Indigenous self-governance as their customs demonstrate aspects of crucial crime prevention theories such as Braithwaite’s theory of reintegrative shaming. The interconnection between reintegrative shaming and Indigenous legal traditions pre-contact and post-contact demonstrate concepts of community socialization, informal sanctions and restorative practices that foster the wellbeing of the community, victims and offenders. Increasing Accountability For Rape In Liberia: The Need For A Forensic System To Increase The Success Rates Of Prosecution, Pela Boker Wilson

The need for a fully functioning forensic system has been identified by the Liberian government and international partners, but it has not been addressed. This Article argues that despite a robust framework put in place to create accountability for rape, Liberia needs a system of collecting and processing forensic evidence to increase the success rate of prosecutions that currently fail due to the inadequacy of non-forensic evidence.

A Look Into Wrongful Conviction Within The U.S. Justice System, Isabella T. Likos
The Downtown Review
The United States justice system has principles in place in order to prevent wrongful convictions such as the presumption of innocence and having to prove beyond a reasonable doubt. However, even with these principles in places there are times that people are wrongfully convicted. There are multiple reasons why wrongful conviction occur, including false confessions and erroneous eyewitness testimony. Wrongful conviction impacts not only the wrongfully convicted, but their family, friends, and the victims. While wrongful convictions do happen, there are steps that can be taken going forward that can help prevent them and exonerate the wrongfully convicted.

The aim of this study was to evaluate facilities in sport cities in Jordan. The sample of this study consisted of (24) employees in sport cities the researcher bilt a tool and validity and reliability was done for the research tool. The results showed that sport cities were in a good condition, however, El-Hussien city was significantly better than the other sport cities. The researcher recommended to using the research tool of this study as instrumentation to evaluate sports facilities in sport cities.

The aim of this study is to clarify the Italian Ambitions in Syria and Lebanon (1870-1945), and shows the Italian orientation in this region, and to know the Italian methods to achieve its ambitions. This study aims at clarifying the impact of implementing the principles of good governance on the quality of administrative reports in the Palestinian municipal councils. A questionnaire was designed to pilot the views of mayors, deputy mayors, directors, heads of departments and employees in Bethlehem and Hebron directorates. Despite the presumption of innocence, we know that individuals accused of crimes are punished for maintaining their innocence in ways both tangible and intangible as they make their way through our criminal justice system. For example, even if instructed not to, jurors may infer guilt from a defendant’s failure to testify; defendants who exercise their right to go to trial receive lengthier sentences if convicted than those who plead guilty; and, once convicted, defendants who maintain their innocence are often denied opportunities for parole or clemency. The new scrutiny that has been applied to the forensic sciences since the emergence of DNA profiling as the gold standard three decades ago has identified numerous concerns about the absence of a solid scientific footing for most disciplines. This article examines one of the lesser-considered problems that afflicts virtually all of the pattern-matching (or “individualization”) disciplines (largely apart from DNA), and even undermines the validity of other forensic disciplines like forensic pathology and medical determinations about child abuse, particularly Shaken Baby Syndrome/Abusive Head Trauma (SBS/AHT). The Carlos Ghosn case has focused the world’s attention on Japan’s criminal justice system. In particular, the system has been subject to intense criticism, condemning its reliance on confessions in investigation, and for proof of guilt. The investigative approach of using physical restraints on suspects and defendants to coerce confessions is critically referred to as “hostage justice”. Recently, legislative campaigns to totally decriminalize the sex trade industry in a handful of U.S. states and the District of Columbia failed, but a look at campaign supporters and their arguments demonstrates that libertarian principles are mainly guiding their efforts. This article explores how libertarianism principles, when applied to the sex trade, could bring about severe and lasting harm to others, including sellers of sex, potential victims of sex trafficking to meet the new demand, and the general community.
