In Mercer v. Hopper, the Georgia Supreme Court, in a four-sentence per curiam opinion, held that "[tihere is no right to counsel at a probation revocation hearing in Georgia." Mercer pleaded guilty to, and was convicted of, three charges of driving under the influence of intoxicants and one charge of forgery. He received a five year sentence for forgery and three 12-month sentences for the DUI charges, the latter to run consecutively, but concurrently with the forgery sentence. All sentences were ordered to be served on probation.

The Street Perspective: A Conversation With The Police, Patrick L. Baude

Professor Baude's purpose in this discussion is to elicit police officers' comments on what members of the legal profession ought to know about the influence of the "street perspective" in shaping those officers' attitudes towards the criminal justice system and the role they play in it. It is police insistence on the broad validity of insights which only "the street" can provide that accounts for the considerable gulf between "front-line" enforcement officers and other functionaries in (and students of) that system. Law students (and no doubt lawyers) seem uncomfortable with the notion that our system cannot adequately be understood without …

A theoretical underpinning of the American system of criminal justice is the notion that a criminal misdeed is a wrong against the entire society.' Accordingly, the local, state and federal governments, acting as the representatives of society, assume the duty and responsibility of prosecuting the individual wrongdoer. While the individual victim of a crime obviously is the party directly" wronged," society interjects and institutes the formal proceeding to ascertain criminal responsibility and determine the appropriate sanction to be imposed upon the accused. Habeas corpus is a subject which has not attracted much attention from legal writers and there has been no thorough examimation of the nature of review which may be exercised on habeas corpus.1 The aim of this article is to provide a critical and comprehensive account of the scope of review which is available on habeas corpus in Canada. The subject is a technical one but may be of crucial importance in those situations where habeas corpus is still a useful remedy. Ex Post Facto Limitations On Legislative Power, Michigan Law Review

This Note explores the rationale underlying the prohibition of ex post facto laws and formulates an analytic framework for a more principled application .of the prohibition. This analytic framework is then used, first, to critique the present strict application of the prohibition to changes in criminal "punishments" and determine whether the prohibition should be applied to sanctions imposed outside the criminal context, and, second, to determine the degree to which the prohibition should be applied to procedural changes.

The Future Of Sentencing Reform: Emerging Legal Issues In The Individualization Of Justice, John C. Coffee Jr.

This article will focus on the mechanics of the individualization process: the manner in which dispositional information is collected, the quality of the resulting data, and the methodologies employed for its communication to and assessment by correctional decision makers. This focus is important because another distinctive feature of the American criminal justice system is the severity of the sentences it imposes. Not only is the average length of sentences imposed on American offenders far in excess of that imposed in other Western nations, but there is considerable evidence that the average length of sentences has increased in direct response to …

On January 1, 1975, the Washington State Uniform Alcoholism and Intoxication Treatment Act (the Act) became effective. It directs that treatment replace punishment as the appropriate mechanism for dealing with alcoholics and intoxicated persons. The Act repeals or amends all criminal law provisions relating to public drunkenness and mandates a comprehensive treatment program for persons with alcohol problems. This note examines the mechanics of the Washington Act and the legislative determination that alcoholism is a disease and that the drinking it induces is beyond the control of the alcoholic. Consideration is given to whether Washington law can consistently treat chronic …
