Objectives: We explored how relations among juror gender, confession evidence, and empathy impacted verdicts for a juvenile defendant accused of a serious crime. Methods: Jury-eligible women and men (N = 128) participated in a mock trial involving a girl defendant who had either maintained her innocence, confessed voluntarily, or confessed under coercion. Participants reviewed case materials, received juror instructions, and reported their verdict and empathy for the girl defendant. A manipulation check ensured participants attended to details surrounding the confession and participants were grouped by whether they perceived the confession as voluntary or coerced. A General Mitigation For Disturbance-Driven Crimes?: Psychic State, Personal Choice, And Normative Inquiries, Paul H. Robinson

It is argued here that the narrow provoked “heat of passion” mitigation available under current law ought to be significantly expanded to include not just murder but all felonies and not just “heat of passion” but potentially all mental or emotional disturbances, whenever the offender’s situation and capacities meaningfully reduce the offender’s blameworthiness for the violation. The trial jury is one of the most basic elements of our court system and is vital for ensuring a fair trial for all parties involved in a case. This research was concerned with the final stage of the jury selection process in which attorneys are able to select, through various challenges, the jurors who are most well suited for service. Particularly, the goal of this research was to determine whether certain juror communicator characteristics, namely interpersonal communication competence and its derivatives, had effects upon jury selection. Abstract: This article begins with the premise that empathy benefits lawyers, irrespective of age, sex, years of experience or nationality. Building on a body of literature that analyzes why empathic relationships are so integral to client satisfaction, and drawing lessons from medical literature addressing the analogous role of empathy in physician-patient relationships, the article argues that real connection with clients also results in lawyer satisfaction, improving quality of professional life and client representation, reducing burn-out and fostering a personal commitment to advancing social justice.
