En el presente artículo se plantean las diferencias entre los mecanismos contractuales cuyos efectos se encuentran vínculados al evento muerte de un invididuo. Con ello se intenta evidenciar, por un lado, que no todo contrato mortis causa es un pacto sucesorio y, por otro lado, que algunos de ellos se erigen como alternativas al testamento. Todo ello importará una reconfiguración de ciertas categorías negociales consideradas institucionales.

The age of centralized information production is over. Today, countless creative enterprises involve decentralized collaboration by hundreds of end-users. Yet, the Copyright Act's last major revision occurred over thirty years ago, when a centralized, corporate model of production was the primary means of delivering information products on a mass-market scale. This Article contends that several features of the Copyright Act, remnants of this earlier corporate-driven era, are outmoded and fail to offer optimal incentives for the decentralized, non-profit-driven model of creative production utilized by many in the software and information-production fields. The purpose of the paper is to explore the minimum age policies of the Big Four sports leagues in the United States (NBA, NFL, MLB and NHL), and discuss the history of their policies. Emphasis is given to the legal battles waged by Spencer Haywood (NBA) and Maurice Clarett (NFL). A discussion of other sports and their minimum age policies is presented as well. The study and history of relevant antitrust law is incorporated as well.

A discussion of the important case involving a decade of litigation involving the Michigan High School Athletic Association (MHSAA) and its insistence that the six girls' sports seasons that did not coincide with the boys' seasons was legal. However, the MHSAA lost its case and high school sports seasons changed beginning fall 2007 to comply with the federal gender-equity law known as Title IX.

Survey Of The Law Of Cyberspace: Electronic Contracting Cases 2006-2007, Juliet M. Moringiello, William L. Reynolds

Juliet M. Moringiello

In this annual survey, we discuss the electronic contracting cases decided between July 1, 2006 and June 30, 2007. In the article, we discuss issues involving contract formation, procedural unconscionability, the scope of UETA and E-SIGN, and contracts formed by automated agents. We conclude that whatever doctrinal doubt judges and scholars may once have had about applying standard contract law to electronic transactions, those doubts have now been largely resolved, and that the decisions involving electronic contracts are following the general law of contracts pretty closely.
