In the United States, both constitutional law and tort law recognize the right to privacy, understood as legal entitlement to an intimate life of one’s own free from undue interference by others and the state. Lesbian, gay, bisexual, and transgender (“LGBT”) persons have defended their interests in dignity, equality, autonomy, and intimate relationships in the courts by appealing to that right. In the constitutional arena, LGBT Americans have claimed the protection of state and federal privacy rights with a modicum of well-known success. The project led by Immanuel Wallerstein’s which is re-examining various aspects/dimensions of polarisations over the last 500 years is a fascinating and ambitious project: ten aspects of the transformations/trends over this long period were chosen in order to examine how matters have been transformed during this time in the core, semi-periphery and periphery of the world-system. The broad themes are the following: wealth; deruralization; urbanization; state power; citizenship’; enterprises; ecology; gender; cultural practices and deviance. Not all papers are so far at the same level of advancement but they will promise to be so in a year’s time.

This article specifically examines the issues and controversies that transsexual individuals have encountered as a result of their lack of protection under anti-discrimination laws, particularly the Americans with Disabilities Act (ADA) and Title VII. Part I is an overview of our society's binary sex/gender system and how this system serves to exclude and disenfranchise transsexuals. Part II examines the relationship between disability law and transsexuals, both explaining why they were excluded from the ADA and how state disability laws have provided more protection. The German constitution, named "Basic Law", has proven to work although many did not believe in it when it was framed. Others emphasize desiderata. Sabine Berghahn commented at the 50th birthday that it has developed "far too slowly and [some] has even gone completely wrong."
