Rethinking Transboundary Ground Water Resources Management: A Local Approach Along The Mexico-U.S. Border, Gabriel E. Eckstein

Despite more than forty years of promises to the contrary, neither Mexico nor the United States have shown any inclination to pursue a border-wide pact to coordinate management of the border region’s transboundary ground water resources. As a result, these critical resources – which serve as the sole or primary source of fresh water for most border communities on both sides – are being overexploited and polluted, leaving the local population with little recourse. Imminently unsustainable, the situation portends a grim future for the region.

This article seeks to expand the U.S. domestic poverty discourse to incorporate cross-border connections of social welfare policy, low-wage work, immigration and international economic organization. The author looks at the U.S. and Mexico as an example in which these multiple legal discourses can be analyzed. First, I explore the long-standing labor and immigration ties between the two countries, and the creation of a false dichotomy within the U.S. of those in wage work and single parent families receiving social assistance benefits. The Party Members’ Court: Judicial Control over Intraparty Disputes in Mexico.

This paper explains how the Electoral Court of the Federal Judicial Branch (TEPJF) of Mexico, without a supporting legislation, was able to establish a direct and far reaching control over intraparty disputes such as the election of party leaders, the selection of candidates, or the punishment of party members. Following a strategic behavior approach, I will provide empirical evidence to prove that there was a negative correlation between the level of judicial control over the parties’ internal life, on the one hand, and the vulnerability of the TEPJF from …
