The paper examines the requirements of each section of Illinois Code of Civil Procedure Section 2-619(a) in greater depth by examining appellate and Illinois Supreme Court rulings in cases brought under each section of 2-619(a). It also analyzes the standards of review appellate courts apply under each section of 2-619(a). Finally, because 619(a) motions require affidavits in support of the motion, it is also necessary to consider the nature and sufficiency of affidavits.

En este artículo se analiza de manera crítica el proceso único de ejecución de desalojo comprendido en el Decreto Legislativo N.º 1177, aplicable a las modalidades contractuales reglamentadas por esta norma: arrendamiento de inmueble destinado a vivienda (arrendamiento tradicional), arrendamiento de inmueble destinado a vivienda con opción de compra, y arrendamiento financiero (leasing) de inmueble destinado a vivienda. Como lo hace ver el autor, destacan como particularidades (novedades) de la nueva regulación la posibilidad de demandar el desalojo por terminación del contrato siempre que se dejen de pagar dos (02) meses consecutivos (supuesto distinto del contemplado en el Código Civil) …

In line with Lenin’s famous quote that Bolsheviks “do not recognise anything private” and that private law must be permeated with public interest, the private (civil) law of the USSR and other countries of the Soviet bloc, including Poland underwent reform aimed at furthering the public interest at the expense of the private one. Specific legal institutions were introduced for this purpose, in the form of legal innovations, loosely, if at all, based on pre-existing Western models. In the Polish case, such legal institutions were usually legal transfers, imported from the Soviet Union. When the socio-economic and political system changed …

In most civil cases filed today, discovery is likely to include electronically stored information (“ESI”). This article details the steps counsel must take when a lawsuit filed, and the article gives particularized instruction on ESI at each juncture. The article discusses the following steps: At Step One, the judge issues an initial scheduling order, which puts into motion several deadlines: the Rule 26(f) conference, the date to submit the parties’ planning report, and the Rule 16 Conference. En una reciente sentencia casatoria, la Sala Civil Permanente de la Corte Suprema ha hecho prevalecer el embargo inscrito frente a la propiedad no registrada. En opinión del autor, esta sentencia, a diferencia de anteriores pronunciamientos, invoca argumentos distintos a los tradicionales, por lo que marca un punto de referencia imprescindible para cualquier análisis de la tendencia jurisprudencial sobre la materia. The Texas Supreme Court has firmly rejected the latest effort to reopen the floodgates for asbestos litigation in Texas. While the Court rejected a formalistic adherence to “but for” causation in mesothelioma, the essence of “but for” still survives because, “but for” legally sufficient proof of exposure to the particular defendant’s product, the defendant cannot be held liable. The requirement of legally sufficient proof applicable to exposure to each defendant’s product remains, and the challenges associated with meeting that requirement remain the same. Perhaps the cohesiveness of this holding will influence other states to define “substantial factor” similarly, or perhaps …

The high cost of the "review of documents" stage of electronic discovery can be solved by having the client index the texts in its records system.Then the client's lawyer can search that index, thus combining the accessing and review stages of electronic discovery, but do it with the speed of electronic searching, rather than reading. Thus the same advantages are created as used in legal research: 1. indexing, 2. expert researcher, and, 3. the speed of electronic searching.
