Court-Created Boundaries Between A Visible Lesbian Mother And Her Children, Susan J. Becker

Law Faculty Articles and Essays

This essay identifies some of the boundaries and obstacles imposed by the courts on a "visible" lesbian mother striving to maintain a healthy relationship with her children. The term "visible" is used to describe a mother whose lesbian sexuality has been revealed to a court empowered with defining her future contact with her children. The primary focus here is on children who were conceived through a heterosexual relationship, and where a heterosexual parent, grandparent, or other person is challenging the lesbian mother's right to custody of, or visitation with, her own children. When President Dwight D. Eisenhower sent federal troops to Little Rock, Arkansas to enforce a school desegregation order at Central High School in the fall of 1957, more than racial equality was at issue. The image of American democracy was at stake. The Little Rock crisis played out on a world stage, as news media around the world covered the crisis. During the weeks of impasse leading up to Eisenhower's dramatic intervention, foreign critics questioned how the United States could argue that its democratic system of government was a model for others to follow when racial segregation was tolerated in …

Gandhi: The Spirituality And Politics Of Suffering, Charles R. Disalvo

Law Faculty Scholarship

This Article examines the 1982 film Gandhi. Although it took factual liberties with Gandhi's life, Professor DiSalvo concludes that it accurately conveyed Gandhi's dedication to self-suffering and philosophy of non-violence. The Article analyzes excerpts from the film which illustrate Gandhi's five fundamental beliefs on the spirituality and politics of suffering. Those beliefs are in suffering as a weapon, as empowerment, as self-interest, as propaganda, and as reconciliation. The film Gandhi also masterfully introduced millions to Gandhi's life, message, and legacy.

Oral Histories

Edward "Ted" Bulleit, Class of 1935, was interviewed on January 7, 1997 by Michael J. Birkner & David Hedrick about his time at Gettysburg College. He discusses his experiences of attending college during the Great Depression, the political science department, fraternity life and the administration of Henry W.A. Hanson. He also describes his years as a law student at Duke University, his time in the US Air Force during World War II, and his return to Gettysburg as a lawyer.

Press Law Debate In Kenya: Ethics As Political Power, David N. Dixon

Communication Educator Scholarship

Journalists in many African countries have long been caught between differing ideals i n their relationship between press and government. Two models vie for dominance-the western, libertarian and development journalism models. This article uses Walzer's (1983) theory of distributive justice to illuminate the ethical significance of this debate. A t issue is political power. A case study of the 1996 proposed press law i n Kenya illustrates the ethical arguments mounted for each press model and how the arguments are marshaled not necessarily for moral purposes but to gain political advantage. THIS PAPER IS THE CO-WINNER OF THE FRED BERGER PRIZE IN PHILOSOPHY OF LAW FOR THE 1999 AMERICAN PHILOSOPHICAL ASSOCIATION FOR THE BEST PUBLISHED PAPER IN THE PREVIOUS TWO YEARS.

The conflict between liberal legal theory and critical legal studies (CLS) is often framed as a matter of whether there is a theory of justice that the law should embody which all rational people could or must accept. In a divided society, the CLS critique of this view is overwhelming: there is no such justice that can command universal assent. But the liberal critique of CLS, that it degenerates into …
