Containerization Of Seafarers In The International Shipping Industry: Contemporary Seamanship, Maritime Social Infrastructures, And Mobility Politics Of Global Logistics, Liang Wu
Dissertations, Theses, and Capstone Projects
This dissertation discusses the mobility politics of container shipping and argues that technological development, political-economic order, and social infrastructure co-produce one another. Containerization, the use of standardized containers to carry cargo across modes of transportation that is said to have revolutionized and globalized international trade since the late 1950s, has served to expand and extend the power of international coalitions of states and corporations to control the movements of commodities (shipments) and labor (seafarers). The advent and development of containerization was driven by a sociotechnical imaginary and international social contract of seamless shipping and cargo flows. In practice, this liberal, …

Driven by ambitious technological developments in automation, statistical figures illustrating that up to ninety per cent of maritime accidents are caused directly or indirectly by Human Element and last but not least by the aspiration to make shipping cos-effective, there are numerous ongoing research and technological developments to realize unmanned ships. The dissertation is a study of the South African limitation of liability for maritime
claims regime in relation to the International conventions on the subject. South
Africa is not a party to the limitation of liability international conventions. South
African limitation legislation is considered and compared to the International
conventions on certain aspects.
Judicial perspectives of certain aspects in relation to the concept of limitation of
liability, like, inter alia, onus of proof, conduct barring limitation and forum
shopping are discussed. In the South African limitation regime, shipowners can
discharge the onus by proving an absence of fault or privity. …

This dissertation focuses on major legal issues of carriage of dangerous goods by sea. Due to the particular features and high risk of dangerous goods during the process of transportation, dangerous goods transportation by sea has always caught the public eye. Nowadays, due to technological development and increasing volume of dangerous goods trade, concerns relating to its legal issues have been seen as a critical matter in the ship-ping industry. The dissertation is an analytical study on international and Ukrainian perspective of the ship arrest, examining the rights and interests of claimants such as mortgagees and holders of maritime liens, but also those of shipowners and ship operators. The purpose of this research is to compare two Arrest Conventions of 1952 and 1999, taking into consideration their historical and theoretical development, problems of implementation and interpretation, differences in the list of individual maritime claims, procedures and rules regarding arrest, rearrest, release and counter security.
