Examining travellers’ preferences for mode choices to understand a rela-tionship between traveller and transport for New South Wales (TfNSW) from the perspective of agency theory (AT) is the main focus of this paper. This paper emphasises on latent and traditional objective attributes to as-sess the mode choice process within the agency relationship as indicated in AT as a method by which the utility of the principal (traveller) can be max-imised. In an open railway access market, the provisions of railway infrastructures and train services are separated and independent. Negotiations between the track owner and train service providers are thus required for the allocation of the track capacity and the formulation of the services timetables, in which each party, i.e. a stakeholder, exhibits intelligence from the previous negotiation experience to obtain the favourable terms and conditions for the track access. Many reasons have been offered to explain why software projects fail. Still, software intensive projects often present schedule delays, cost overruns and delivering products with reduced functionality. This paper argues that lack of knowledge is yet another factor that causes projects to under perform, which in turn drives undesirable social behaviour that worsens the situation. Software intensive projects develop solutions highly dependent on software that should satisfy a need.
