On April 19 and 20, 2023, Professors Bernard Hibbitts and Richard Weisberg convened a conference at the University of Pittsburgh School of Law titled “Disarmed, Distracted, Disconnected, and Distressed: Modern Legal Education and the Unmaking of American Lawyers.” Four speakers concluded the event with a spirited conversation about themes expressed during the proceedings. The high rate of business failures within the first 5 years negatively affects half of startup business owners. Small retail business owners who fail to develop innovative entrepreneurial strategies experience high failure rates within the first 5 years of operation. Grounded in self-determination theory, the purpose of this qualitative multiple case study was to explore entrepreneurial strategies small retail business owners use to support long-term sustainability. Participants were five small retail business owners from Southern Illinois who successfully used entrepreneurial strategies to reduce high failure rates. The development of a theory of innovation for hospitality innovation finds heightened importance due to the COVID-19 Pandemic that has unleashed a devastating and sustained disruption on global hospitality and tourism. The problem for research is that the industry lacks a taxonomy for research on innovation in hospitality. This study addresses the gap in understanding the nomological relationship between innovation constructs and the observable manifestations of innovation in the hospitality industry. Before an academic entrepreneur may protect or commercialize an invention, they must understand if they own the rights to it. This short chapter helps the inventor to consider the various scenarios that occur in a university setting. It advises the inventor how to seek a waiver from the university if they believe they are the true owner of the invention. If the facts indicate that the invention should be owned by the university, the chapter also discusses how a university decides to formally protect the invention through patent or copyright. If an academic entrepreneur wants to commercialize their invention, they must first clarify who owns the invention, and then decide on the best commercialization possibility. This short chapter describes the various scenarios that might occur in a university setting. In most cases, a university will own the invention created by its researchers and faculty because of their employment. A university may then either license out the entrepreneur’s invention to a third-party company to further develop and commercialize, or may license the invention back to the entrepreneur so that they may commercialize it themselves through a start-up.
