This report describes the process for certification for bilingual education and bilingual special education, the number and type of programs available in New York State to prepare individuals for certification, the incentives and other programs in the state designed to recruit and assist individuals in pursuing certification, and provides recommendations for how to increase the number of properly certified bilingual education and bilingual special education teachers in the state.

This study explores the level of compliance with New York State laws on bilingual education in selected school districts. Our assessment of compliance with New York State Education Department (NYSED) regulations on bilingual education is based on the 2008-2009 CR Part 154 applicationsfiled by the schools. The CRPart 154 applications we examined for this reportc ontain 2007-2008 data on the number of identified ELLs in each school, as well as the number of ELLs served by bilingual and ESL programs as reported by the schools. In this study, I examine the factors that influence school districts’ commitment to implement ESL (English as a Second Language) education in compliance with the federal Bilingual Education Act of 1968. To explain variation in implementation effort, I focus on several features of the local implementation environment, including the role of Latino descriptive representation.
