Reflections on lessons learnt during online teaching during COVID-19. Despite the difficulties of the term, I realized that online teaching had certain strengths that traditional face-to-face teaching formats lacked. This started me on the path to adapting online teaching practices to improve our current modes of teaching, such as using online tools to improve interactivity, and reduce bias in interacting with students. I also started reconsidering whether our traditional classroom structures are indeed the best way to teach. While my experiences are based on teaching law, I believe that these points are also applicable to teaching in other disciplines.

Distance learning is now a central component of the law school curriculum. The COVID-19 pandemic forced law schools to engage in emergency remote teaching after in-person instruction became too dangerous. As a result, nearly every law school is now engaging in some form of distance learning, at least temporarily. Fortunately, sophisticated models exist for both synchronous and asynchronous online learning. And online delivery of the J.D. curriculum is not brand new to legal education. Technology lawyers, intellectual property (IP) lawyers, or even any corporate lawyer with technology clients must understand standard essential patents (SEPs) and how their licensing works to effectively counsel their clients. Whether the client’s technology is adopted into a voluntary standard or not may be the most important factor in determining whether the company succeeds or is left behind in the market. Yet even though understanding SEPs is critical to a technology or IP practice, voluntary standards and specifically SEPs are generally not taught in law school.

The American Bar Association (ABA) accreditation standards involving outcome-based assessment are a game changer for legal education. The standards reaffirm the importance of providing students with formative feedback throughout their course of study to assess and improve student learning. The standards also require law schools to evaluate their effectiveness, and to do so from the perspective of student performance within the institution’s program of study. This Article discusses systems thinking as an innovative approach to contextualizing legal advocacy. Systems thinking, a paradigm that emphasizes universal interconnectivity, provides a theoretical basis for parsing the structural environment in which law-related problems emerge and are addressed. From the array of conceptions about what it means to engage in systems thinking, this Article identifies four key tenets to this perspective: (1) every outcome is the product of some structure; (2) these structures are embedded within and connected to one another; (3) the structure producing an outcome can be discerned; and (4) these structures are resilient, but not fixed. The COVID-19 pandemic has laid bare not only the social and racial inequities in society, but also the pedagogical and access to justice inequities embedded in the traditional legal curriculum. The need to re-envision the future of legal education existed well before the current pandemic, spurred by the shifting nature of legal practice as well as demographic and technological change. This article examines the impact of the COVID-19 pandemic on legal education, and posits that the combined forces of the pandemic, social justice awareness and technological disruption will forever transform the future of both legal education and practice.

Lost & Found is a tabletop-to-mobile game series designed for teaching medieval religious legal systems. The long-term goals of the project are to change the discourse around religious laws, such as foregrounding the prosocial aspects of religious law such as collaboration, cooperation, and communal sustainability. This design case focuses on the evolution of the design of the mechanics and core systems in the first two tabletop games in the series, informed by over three and a half years’ worth of design notes, playable prototypes, outside design consultations, internal design reviews, playtests, and interviews.
