Houve tempo em que a Constituição servia para poisar ou charuto ou tirar um argumento político, como ironicamente afirmaria o grande escritor oitocentista Eça de Queiroz. Hoje a Constituição é a norma das normas. Daí há consequências hermenêuticas. Ao contrário das teorias que importam interpretação tradicional e, por vezes, em grande medida ultrapassada, para o Direito Constitucional, a tendência actual é a inversa: dada a supremacia da Constituição, deve ser a metodologia constitucional a exportar hermenêutica para o todo do Direito. Para isso, começamos neste artigo com grandes princípios de hermenêutica intra-constitucional. Depois se passará à exportação.

During the past five years, virtual schools in the United States have gained popularity and acceptance as viable alternatives to the traditional school system through provisions for charter schools under Title V, Part B, Subpart 1 of the Elementary and Secondary Education Act of 1965 (ESEA), as amended by the No Child Left Behind Act of 2001. This paper describes the existing federal policies that are driving the online virtual school movement, and how one state, Nevada, has set forth and interpreted specific policies regarding online distance education. A major policy issue confronting states is the level of state support to higher education. A crucial question in this policy debate is whether a state's production of college graduates has a proportionate effect on the level of college attainment in the state. Although it is widely accepted that rising college attainment leads to rising prosperity, there is widespread concern that many new college graduates will take their state-supported degrees to labor markets in other states. The belief that state support to higher education subsidizes the workforce development of other states undermines states' incentives to promote wider access to higher …

Governmentality And U.S. Congressional Discourse Regarding Abstinence-Only Sexuality Education, Wm S. Boozer

To investigate how federal discourse constructs adolescence, the author analyzed discussions of abstinence-only sexuality education from the U.S. Congressional Record from 2001 to 2007. He used grounded theory methodology to identify theoretical codes and construct a model from the data. The grounded theory developed focused on Congress’s maintenance of its role in mediating concern over the sexual behavior of adolescents as opposed to finding a solution to the problem it had identified. The author relates this theory to Foucault’s (1974/1991) concept of governmentality. He discusses Congress’s discourse about adolescence using Lesko’s (2001) confident characteristics of adolescence as a framework.

Improving the teaching of English as a foreign language in public schools is a high priority for the Dominican administration elected in 2004. Consequently, the government’s plan of action includes a pilot project that integrates language teaching strategies and methods already found in the country’s private, K-12, foreign language programs. The purpose of this naturalistic inquiry was to investigate English teaching through case studies at two private schools in hopes of guiding the country’s educational policy. February 2003 was the inauguration of the Foundations of Excellence project with an open invitation to chief academic officers at approximately 900 of both the American Association of State Colleges and Universities (AASCU) and the Council for Independent Colleges (CIC) member institutions. The Policy Center on the First Year of College, under the direction of the Executive Director, John N. The purpose of this study was to research the experiences of female academicians in traditional liberal arts academic disciplines at one institution. The challenges of being a female academician are revealed in statistical data about faculty rank, tenure, and salaries as well as in descriptive accounts of the environment that women encounter in the higher education institutions. Using a quasi-experimental design, the author examined the effects of the Professional Development School Partnerships Deliver Success educational model on student academic achievement in science and mathematics in 12 high-needs, urban elementary, middle, and high schools in the southeastern United States. Student achievement was measured for first to eighth grade students by the State Criterion-Referenced Competency Test and for 11th-grade students by the State High School Graduation Test. 6 ANOVAs were used to compare baseline and year 1 performance data. This qualitative study investigated the roles students play in institutional decision-making, and in particular how the students perceive both what their roles should be and what their roles actually are. Five Student Government Association (SGA) presidents, serving sequential one-year terms from 1999 to 2004 at one campus of a multi-campus two-year public college located in a large metropolitan area in the southeast, were interviewed. Gender And The Evolution Of Normal School Education: A Historical Analysis Of Teacher Education Institutions, Chara H. Bohan, Wesley Null

A historical analysis of the confluence of gender and teacher education curriculum at specific normal schools in Texas between 1890 and 1930 is provided. Comparing these stories reveals the influence of the expansion of public education on teacher education curricula, the influence of gender on the development of teacher education, and how the nature of the curriculum offered reflected the impact of gender.

The recent repeal of Maine’s local education assessment requirement was met with mixed reactions ranging from relief to outrage. That there were such differing responses points to the fact that “assessment” in education is understood in diverse and sometimes contradictory ways. In this article, Rebecca Berger looks retrospectively at how the problems associated with implementing Maine’s local assessment system (LAS) were caused by a lack of understanding of important aspects of assessment as it relates to standards-based reform in education. The persistent achievement gaps among children of different race/ethnicity and socioeconomic status in the United States represent an issue that has commanded public, policy, and research attention on and off for about 100 years now, and it is once again in the forefront of policy-making agendas. Debates nevertheless abound on the most promising and cost-effective strategies to address the problem. We examine critically the available evidence on the benefits and costs of early childhood education and conclude that early, vigorous interventions targeted at disadvantaged children offer the best chance to substantially reduce gaps in school readiness and increase the productivity …
