Third Party Access And Refusal To Deal In European Energy Networks: How Sector Regulation And Competition Law Meet Each Other, Michael Diathesopoulos Dec 2010

Third Party Access And Refusal To Deal In European Energy Networks: How Sector Regulation And Competition Law Meet Each Other, Michael Diathesopoulos

Michael Diathesopoulos

In this paper, we will analyse the issue of concurrence between competition and sector rules and the relation between parallel concepts within the two different legal frameworks. We will firstly examine Third Party Access in relation to essential facilities doctrine and refusal of access and we will identify the common points and objectives of these concepts and the extent to which they provide a context to each other’s implementation. Second, we will focus on how Commission uses sector regulation and objectives as a context within the process of implementation of competition law in the energy sector and third, we will …

The New Financial Deal: Understanding The Dodd-Frank Act And Its (Unintended) Consequences, David A. Skeel Jr. Oct 2010

The New Financial Deal: Understanding The Dodd-Frank Act And Its (Unintended) Consequences, David A. Skeel Jr.

All Faculty Scholarship

Contrary to rumors that the Dodd-Frank Act is an incoherent mess, its 2,319 pages have two very clear objectives: limiting the risk of the shadow banking system by more carefully regulating derivatives and large financial institutions; and limiting the damage caused by a financial institution’s failure. The new legislation also has a theme: government partnership with the largest Wall Street banks. The vision emerged almost by accident from the Bear Stearns and AIG bailouts of 2008 and the commandeering of the bankruptcy process to rescue Chrysler and GM in 2009. Its implications for derivatives regulation could prove beneficial: Dodd-Frank will …

The Effect Of Claw Horn Disruption Lesions And Body Condition Score At Dry-Off On Survivability, Reproductive Performance, And Milk Production In The Subsequent Lactation, V. S. Machado, L. S. Caixeta, J. A. A. Mcart, R. C. Bicalho

Farm Animal Welfare Collection

The objective of this study was to evaluate the effects of claw horn disruption lesions (CHDL; sole ulcers and white line disease) and body condition score (BCS) at dry-off on survivability, milk production, and reproductive performance during the subsequent lactation. An observational prospective cohort study was conducted on a large commercial dairy in Cayuga County, New York, from September 2008 until January 2009. A total of 573 cows enrolled at dry-off were scored for body condition and hoof trimmed; digits were visually inspected for the presence of CHDL. The BCS data were recategorized into a 3-level variable BCS group (BCSG), …

From Energy Sector Inquiry To Recent Antitrust Decisions In European Energy Markets: Competition Law As A Means To Implement Energy Sector Regulation In Eu, Michael Diathesopoulos Jul 2010

From Energy Sector Inquiry To Recent Antitrust Decisions In European Energy Markets: Competition Law As A Means To Implement Energy Sector Regulation In Eu, Michael Diathesopoulos

Michael Diathesopoulos

This paper presents the conceptual path followed by European Union, European Commission and European Competition Network, after the Energy Sector Inquiry (2007) towards the realisation of the objective of an Energy Internal Market, fully functional and open to competition. Firstly, we examine the findings of Sector Inquiry and then we describe how the Third Energy Package - that followed - tried to address the issues highlighted by the Inquiry and how Third Energy Package introduces a promising but complex system, in order to develop sector rules. Following the above, we proceed to a brief but close examination of 10 recent …

Relational Contract Theory And Management Contracts: A Paradigm For The Application Of The Theory Of The Norms, Michael Diathesopoulos Jun 2010

Relational Contract Theory And Management Contracts: A Paradigm For The Application Of The Theory Of The Norms, Michael Diathesopoulos

Michael Diathesopoulos

This paper examines management contracts as a paradigm for the application of relational contracts theory and especially of the theory of contractual and relational norms. This theory, deriving from Macauley's implications, but structured and analysed by I.R. MacNeil gives us a framework for the explanation and understanding of contractual obligations and business relations' rules and practice. After presenting the key literature about the norms theory and especially defining the content of MacNeil's norms, we define management contracts as relations, characterised by a high relational element and we explain why, investigating all their features, which make them a suitable object for …

Basic Education And Education For All In Nigeria: The Role Of Multinational Corporations, Mary Plangnan Haggai Jun 2010

Basic Education And Education For All In Nigeria: The Role Of Multinational Corporations, Mary Plangnan Haggai

Journal of Global Initiatives: Policy, Pedagogy, Perspective

In spite of the concerted efforts made by the Nigerian government at funding the Universal Basic Education (UBE) in the country, 11 million children of school age are still out of school. To augment the funding, the paper proposes the involvement of multinational corporations. Participation in UBE is seen as a tangible Corporate Social Responsibility (CSR) project that will have direct impact on the host communities in such a way that will eliminate the hostilities of the host communities towards multinational corporations.

Legal And Ethical Implications Of Corporate Social Networks, Gundars Kaupins, Susan Park Jun 2010

Legal And Ethical Implications Of Corporate Social Networks, Gundars Kaupins, Susan Park

Management Faculty Publications and Presentations

Corporate social networking sites provide employees and employers with considerable opportunity to share information and become friends. Unfortunately, American laws do not directly address social networking site usage. The National Labor Relations Act, civil rights laws, and various common law doctrines such as employment at-will and defamation provide the pattern for future social networking laws. Ethical considerations such as productivity, security, goodwill, privacy, accuracy, and discipline fairness also affect future laws. Corporate policies on corporate social networking should balance the employer‘s and employee‘s interests. Existing laws and ethical issues associated with social networking should impact social networking policies related to …

The Politics Of Partnerships. A Critical Examination Of Nonprofit-Business Partnerships, Maria May Seitanidi Apr 2010

The Politics Of Partnerships. A Critical Examination Of Nonprofit-Business Partnerships, Maria May Seitanidi

Maria May Seitanidi

The widespread partnering phenomenon in the US and the UK spurred a significant amount of literature focusing on its strategic use. The Politics of Partnerships diverges by examining if partnerships can deliver benefits that extend beyond the organisational to the societal level resulting from the intentional combined efforts of the partners. The book offers under the chronological stages of formation, implementation, outcomes a critical examination and proposes a holistic framework for the study of partnerships allowing for observations beyond any single stage.

Media Attention & Executive Pay In The Netherlands, Jordan Otten Apr 2010

Media Attention & Executive Pay In The Netherlands, Jordan Otten

Jordan Otten

This report is centered around three research questions on newspaper coverage and executive compensation in The Netherlands. 1) How has the coverage developed over the years? 2) How selective are newspapers in their coverage? And 3) What are the influences of newspaper coverage on executive compensation?

Based on the articles that have appeared in the period 1998- mid 2009, it can be concluded that the attention by newspapers is not only of the most recent years. Newspapers do not systematically focus on the better or worse performing companies and do also not focus on the higher or highest paid executives. …

Measures Of Weight Distribution Of Dairy Cows To Detect Lameness And The Presence Of Hoof Lesions, M. Pastell, L. Hänninen, A. M. De Passillé, J. Rushen Mar 2010

Measures Of Weight Distribution Of Dairy Cows To Detect Lameness And The Presence Of Hoof Lesions, M. Pastell, L. Hänninen, A. M. De Passillé, J. Rushen

Farm Animal Welfare Collection

There is increasing interest in automated methods of detecting lame cows. Hoof lesion data and measures of weight distribution from 61 lactating cows were examined in this study. Lame cows were identified with different numerical rating scores (NRS) used as thresholds (NRS >3 and NRS ≥3.5) for lameness. The ratio of weight applied to a pair of legs (LWR) when the cow was standing was calculated using a special weigh scale, and the cows were gait scored using a 1 to 5 NRS. Hoof lesions were scored and the cows placed into 1 of 4 mutually exclusive categories of hoof …

Assessment Of Lameness Prevalence And Associated Risk Factors In Dairy Herds In England And Wales, Z. E. Barker, K. A. Leach, H. R. Whay, N. J. Bell, D. C. J. Main Mar 2010

Assessment Of Lameness Prevalence And Associated Risk Factors In Dairy Herds In England And Wales, Z. E. Barker, K. A. Leach, H. R. Whay, N. J. Bell, D. C. J. Main

Farm Animal Welfare Collection

Visits were made to 205 dairy farms in England and Wales between October 2006 and May 2007 by 1 or more of 4 researchers. At each visit, all milking cows were locomotion scored (lameness scored) using a 4-point scale (0 = sound locomotion, 1 = imperfect locomotion, 2 = lame, 3 = severely lame). The mean prevalence of lameness (scores 2 and 3) across the study farms was 36.8% (range = 0–79.2%). On each farm, the presence within the housing and grazing environments of commonly reported risks for increased lameness was recorded. Each farmer was interviewed to gauge the ability …

Redefining The Epistomology Of The Coporate / Not-For-Profit Engagement, David Cooke Dr

David Cooke

An understanding of why corporations engage in corporate social investment and corporate philanthropy is vital if not-for-profit organisations are to engage effcetively in raising funds from this sector. This article indicates that their is a return on investment for companies who partner with the not-for-profit sector and approaches need to focus on this rather than an appeal to altruism.

Emotional Intelligence And Cognitive Moral Development In Undergraduate Business Students, Elizabeth Pluskwik Jan 2010

Emotional Intelligence And Cognitive Moral Development In Undergraduate Business Students, Elizabeth Pluskwik

Integrated Engineering Department Publications

This study examines relationships between emotional intelligence (EI) and cognitive moral development (CMD) in undergraduate business students. The ability model of emotional intelligence was used in this study, which evaluated possible relationships between EI and CMD in a sample of 82 undergraduate business students. The sample population was approximately 700 students in a private university in the Midwest United States. A weak, positive relationship was found between overall emotional intelligence and moral development, but the strength of this relationship failed to reach statistical significance. However, one branch of EI, Understanding Emotions, did have a positive correlation with moral development at …

Understanding Mortality Rates Of Laying Hens In Cage-Free Egg Production Systems, The Humane Society Of The United States Jan 2010

Understanding Mortality Rates Of Laying Hens In Cage-Free Egg Production Systems, The Humane Society Of The United States

Agribusiness Collection

In cage-free egg production systems, concerns have been raised over hen mortality rates. High mortality is an obvious indicator of poor welfare, and problems should be addressed without delay. It is important to note, however, that mortality can vary substantially between hen flocks, and that some cage-free systems have healthy flocks that do not suffer substantial death losses. These systems can serve as models for the rest of the industry, since mortality is not inherent to any particular system, but a consequence of how well the system is managed.

Missouri’S Dirty Dozen: A Report On Some Of The Worst Puppy Mills In Missouri, The Humane Society Of The United States Jan 2010

Missouri’S Dirty Dozen: A Report On Some Of The Worst Puppy Mills In Missouri, The Humane Society Of The United States

PUPPY MILL INFORMATION

The purpose of the report is to demonstrate current problems that could be addressed by the passage of Proposition B, which Missouri citizens will vote on in November. Under Proposition B, the Puppy Mill Cruelty Prevention Act, many of these dealers’ horrific violations would be backed by stronger enforcement opportunities.

All of the puppy mills on the Dirty Dozen list are licensed by the USDA, the state, or both, according to the most recently available records reviewed by HSUS researchers. Some sell puppies to pet stores and others over the Internet. One thing they have in common is atrocious violations …

De Coöperatie, Organisatievorm Uit Het Verleden Voor Onze Samenleving Van Morgen?, Wim Van Opstal

Wim Van Opstal

Daarnaast …

Armoede Te Huur. Ervaringsdeskundigheid Op Een Schoteltje., Birgit Goris, Wim Van Opstal Jan 2010

Armoede Te Huur. Ervaringsdeskundigheid Op Een Schoteltje., Birgit Goris, Wim Van Opstal

Wim Van Opstal

Werken Met En Voor Mensen In Kansarmoede. Een Evaluatie Van Het Project Tao Limburg, Birgit Goris, Ann Moreels, Wim Van Opstal

Wim Van Opstal
