Regional Trade Agreements And Compliance To Wto Rules, Kevin Dalglish P. Dec 2012

Regional Trade Agreements And Compliance To Wto Rules, Kevin Dalglish P.

Kevin Dalglish P.

The multilateral trading system existed first as the GATT from 1947 to 1994 and then as the WTO since 1995. Regional Trade Agreements (“RTAs”), defined as “a free-trade agreement, customs union or common market consisting of two or more countries” , however, began coming into their own only in the 1990s. Before that, there were virtually no such agreements until 1970 and less than 50 in 1990. This suggests that greater reduction in trade barriers (both tariff and non-tariff) was achieved in the earlier rounds of the GATT, which precluded the need for countries to resort to RTAs. Once, however, …

Beyond Empiricism: Realizing The Ethical Mission Of Management, Julian Friedland Sep 2012

Beyond Empiricism: Realizing The Ethical Mission Of Management, Julian Friedland

Julian Friedland

Research into the proper mission of business falls within the context of theoretical and applied ethics. And ethics is fast becoming a part of required business school curricula. However, while business ethics research occasionally appears in high-profile venues, it does not yet enjoy a regular place within any top management journal. I offer a partial explanation of this paradox and suggestions for resolving it. I begin by discussing the standard conception of human nature given by neoclassical economics as disseminated in business schools; showing it is a significant obstacle to an accurate conception of ethics and how this limits consideration …

Fraud Prevention In Nigeria: Applying The Forensic Accounting Tool, Professor Ben C Osisioma

Prof Ben Chuka Osisioma

The spate of global scandals and corporate misadventures that began with the energy giant, Enron in the years 2000 to 2002, the Asian Financial Crisis of 1997/98, and the global Financial Meltdown of 2008, rocked the accountancy profession and sharply drew attention to the need for the profession to re-invent itself and re-define its focus in the new millennium. Accounting practitioners world-wide, have tested the limits of creative accounting, and the verdict of the marketplace is that the era of sharp and unwholesome practices are over for good. Part of the professional response to challenge of this era, is the …

Vaccination : Who's Right And Whose Right To Say So?, Stephen S. Holden Jun 2012

Vaccination : Who's Right And Whose Right To Say So?, Stephen S. Holden

Stephen S Holden

Are social marketers really ethical? This essay extends Brenkert’s (2001, 2002) exploration of some of the ethical issues that confront, or perhaps ought to confront social marketers. It contributes to social marketing by adding to the list of ‘mythunderstandings’ offered by Donovan (2011) as follows: social marketing is not inherently and ethically good (even though “social good” is the objective). The implication for social marketing is that the notion of “doing good” needs to be subject to reasonable doubt and critical thinking rather than supported by untrammelled belief.

Stark Voluntary Self-Referral Disclosure Protocol (Srdp) And Stark Law, Kip Klingman May 2012

Stark Voluntary Self-Referral Disclosure Protocol (Srdp) And Stark Law, Kip Klingman

Kip Klingman

When you’ve made a serious mistake, sometimes it is best to step forward and confess before the government regulators find out on their own. The federal Stark Law, governing physician self-referral, provides a mechanism for voluntary disclosing a violation, but using that option requires a carefully crafted game plan.

Risks Of Criminal Liability For Union Business Agents, Edwin Render Feb 2012

Risks Of Criminal Liability For Union Business Agents, Edwin Render

Edwin R. Render

This paper discusses some of the risks of violating criminal laws that union stewards and business agents encounter in connection with representing employees. It is not about RICO. The analysis is particularly focused on the types of crimes they might commit inadvertently in grievance meetings with management, when preparing and presenting cases in labor arbitrations and in representing and advising employees in matters such as worker’s compensation and unemployment compensation proceedings. The potential for criminal liability is discussed for business agents and union stewards in both the public and private sectors. While most business agents or stewards would not intentionally …

Keeping Tribal Business Partners Close – And Their Lawyers Closer, Ryan D. Dreveskracht Jan 2012

Keeping Tribal Business Partners Close – And Their Lawyers Closer, Ryan D. Dreveskracht

Ryan Dreveskracht

Tribes, in appropriate instances, should ensure that their non-Indian business partners have engaged attorneys that are familiar with the fundamental principles of Indian law. Although this strategy may seem counterintuitive, a tribal party should pause during the deal to consider the old adage that “bad facts make for bad law,” while also accepting that commercial disputes are inevitable, especially in modern economic times. The tribal party should also pause to consider that it is increasingly appropriate to litigate these disputes on the merits, rather than bank on seeking a quick dismissal on Indian jurisdictional grounds – a dismissal that will …

Transferability And Commercialization Of Patent Rights: Economic And Practical Perspectives, Haim V. Levy Jan 2012

Transferability And Commercialization Of Patent Rights: Economic And Practical Perspectives, Haim V. Levy

Journal of Entrepreneurship, Management and Innovation JEMI

The transformation of innovation into commercial value depends primarily on appropriate protection of the intellectual property, usually by patents, and efficient pathway(s) of its transferability as well as the transfer of the protected knowledge. The key features of patents, from an economic perspective, are that they encompass new knowledge and confer monopoly rights to the owner. The exclusiveness of patent rights is generally conceived as a necessary mechanism to ensure further innovation, stimulate advanced research and facilitate efficient market transactions with patent rights. The patent holder can transfer the technology embodied by way of granting to others a license to …

Next the concept of Age Management is defined, both from the macro, enterprise-level and individual perspectives. The next section studies the benefits derived from implementing Age Management for the company and its employees, followed by a section on specific Age Management tools and measures. The penultimate section explores the prerequisites for successful implementation. This paper …

Lawrence J. Trautman Sr.

In a previous publication The Board’s Responsibility for Information Technology Governance, (with Kara Altenbaumer-Price) we examined: The IT Governance Institute’s Executive Summary and Framework for Control Objectives for Information and Related Technology 4.1 (COBIT®); reviewed the Weill and Ross Corporate and Key Asset Governance Framework; and observed “that in a survey of audit executives and board members, 58 percent believed that their corporate employees had little to no understanding of how to assess risk.” We further described the new SEC rules on risk management; Congressional action on cyber security; legal basis for director’s duties and responsibilities relative to IT governance; …

False Beliefs, Partial Truths: Personal Myths And Ethical Blind Spots, Crina Archer, Laura Hartman Jan 2012

False Beliefs, Partial Truths: Personal Myths And Ethical Blind Spots, Crina Archer, Laura Hartman

Laura Hartman

While unethical actions may arise from conscious, deliberate and reflective choices to do ‘wrong,’ many unethical decisions emerge instead from an absence of awareness of ethical responsibility. The metaphor of ‘blind spots’ has been deployed productively to describe mental obstacles that impede ethical responsibility at the individual level, but do not rise to the level of conscious awareness. Blind spots prevent us from attending to relevant data, different points of view, alternative solutions, and foreseeable consequences crucial to forging an ethical response. We identify three common myths that tend to foster ethical blind spots at the individual level by rendering …

Trust After The Global Financial Meltdown, P. Werhane, Laura Hartman, D. Bevan, K. Clark, C. Archer Jan 2012

Trust After The Global Financial Meltdown, P. Werhane, Laura Hartman, D. Bevan, K. Clark, C. Archer

Laura Hartman

Over the last decade, and culminating in the 2008 global financial meltdown, there has been an erosion of trust and a concomitant rise of distrust in domestic companies, multinational enterprises, and political economies. In response to this attrition, this paper presents three arguments. We propose that the stakes of violating public trust are particularly high in light of the asymmetry between trust and distrust; we identify a constellation of key barriers to overcoming distrust that companies face in the current environment; and we argue that, notwithstanding these challenges, these phenomena are not fatal and can be addressed through a holistic …

Do Women In Top Management Affect Firm Performance? Evidence From Indonesia, Salim Darmadi Jan 2012

Do Women In Top Management Affect Firm Performance? Evidence From Indonesia, Salim Darmadi

Salim Darmadi

This paper investigates the relationship between gender diversity on management boards and financial performance of Indonesian listed companies. We conduct cross-sectional regression analysis based on a sample comprising 92.4 percent of public firms listed on the Indonesia Stock Exchange (IDX). We find that the representation of female top executives is negatively related to both accounting and market performance, suggesting that female representation is not associated with improved level of performance. From correlation analysis, our results also reveal that smaller firms, which tend to be family-controlled, are more likely to have higher proportion of female members on management boards. This implies …

Coöperaties In België. Profielschets 2005-2010, Wim Van Opstal

Wim Van Opstal
