Containerization Of Seafarers In The International Shipping Industry: Contemporary Seamanship, Maritime Social Infrastructures, And Mobility Politics Of Global Logistics, Liang Wu

Dissertations, Theses, and Capstone Projects

This dissertation discusses the mobility politics of container shipping and argues that technological development, political-economic order, and social infrastructure co-produce one another. Containerization, the use of standardized containers to carry cargo across modes of transportation that is said to have revolutionized and globalized international trade since the late 1950s, has served to expand and extend the power of international coalitions of states and corporations to control the movements of commodities (shipments) and labor (seafarers). The advent and development of containerization was driven by a sociotechnical imaginary and international social contract of seamless shipping and cargo flows. In practice, this liberal, …

From Polygraphs To Truth Machines: Artificial Intelligence In Lie Detection, Jo Ann Oravec

Critical Humanities

The proliferation of artificial intelligence (AI)-enhanced lie detection tools in business, educational, community, and governmental contexts signals a new era of deception detection. With these AI developments, collections of intimate biometric information such as facial and retinal data, keystroke patterns, brain scans, and physiological changes in the cardiovascular system are combined with personal profiles to produce analyses of a subject’s supposed veracity. This article explores some early lie detection technologies (such as the polygraph) and discusses the influences that lie detection initiatives have had in human interactions through the decades. Ensuring Responsible And Transparent Use Of Generative Ai In Extension, Paul A. Hill, Lendel K. Narine

The Journal of Extension

Generative artificial intelligence (AI) systems capable of generating human-like text, images, and ideas from existing data based on user-defined prompts, will inevitably impact Extension, including increasing efficiency, productivity, and performing tasks previously exclusive to humans. There are ethical and risk-related considerations surrounding the use of generative AI, including concerns about bias and unintended consequences. It is important for Extension to consider these implications and take steps to ensure that generative AI is used in a responsible and transparent manner. Extension must ensure that educators and staff have the necessary knowledge and skills to effectively utilize and integrate this technology.

Swipe Right Into A Disciplinary Hearing: How The Use Of Dating Apps Could Earn An Attorney More Than A Bad First Date, Zachary S. Aman

Catholic University Journal of Law and Technology

The Model Rules of Professional Conduct seek to police the conduct of attorneys. Each jurisdiction adopts its own rules of professional conduct to apply to the attorneys licensed within it. Notably, the model rules prohibit any sexual relationship between the attorney and client unless that relationship precedes the attorney-client relationship. Traditionally, defining a "sexual relationship" was simple, particularly if the attorney and client engaged in sexual intercourse. The introduction of dating apps, however, has blurred the line.

This article outlines the inherent risks of attorneys using dating apps at a time when most newly-licensed attorneys make up the majority of …

Electronic Theses and Dissertations

Sales supervisors can tremendously influence the sales teams they manage, and their behaviors can influence a team’s engagement and sales performance. Because of the supervisor’s influential role, their behavior, positive or negative, can ripple throughout the organization. As a result, a supervisor who role models abusive behavior within their organization also promotes a climate of abuse and incivility that can contribute to a toxic workplace. Abusive supervision (AS) is a significant problem in many business-to-business (B2B) sales organizations that negatively impacts the financial welfare and subjective well-being of organizations and their employees. This quantitative correlational study aimed to examine how …

The Application Of The Right To Be Forgotten In The Machine Learning Context: From The Perspective Of European Laws, Zeyu Zhao Jan 2022

The Application Of The Right To Be Forgotten In The Machine Learning Context: From The Perspective Of European Laws, Zeyu Zhao

Catholic University Journal of Law and Technology

The right to be forgotten has been evolving for decades along with the progress of different statutes and cases and, finally, independently enacted by the General Data Protection Regulation, making it widely applied across Europe. However, the related provisions in the regulation fail to enable machine learning systems to realistically forget the personal information which is stored and processed therein.

This failure is not only because existing European rules do not stipulate standard codes of conduct and corresponding responsibilities for the parties involved, but they also cannot accommodate themselves to the new environment of machine learning, where specific information can …

À La Carte Cable: A Regulatory Solution To The Misinformation Subsidy, Christopher R. Terry, Eliezer J. Silberberg, Stephen Schmitz, John Stack, Eve Sando

Catholic University Journal of Law and Technology

Although “fake news” is as old as mass media itself, concerns over disinformation have reached a fever pitch in our current media environment. Online media outlets’ heavy reliance on user-generated content has altered the traditional gatekeeping functions and professional standards associated with traditional news organizations. The idea of objectivity-focused informational content has primarily been substituted for a realist acceptance of the power and popularity of opinion-driven “news.” This shift is starkly visible now: mainstream news media outlets knowingly spread hoaxes, conspiracy theories, and the like.

This current state of affairs is not some freak accident. The Supreme Court’s First Amendment …

Will Products Liability Litigation Help Protect Iot Users From Cyber-Physical Attacks?, J Royce Fichtner, Troy J. Strader

Journal of International Technology and Information Management

While there is an identifiable trend towards protecting consumers from data breaches and data misuses related to IoT devices through new legislation, new regulations, government enforcement actions, and private lawsuits, there has been little progress towards creating similar legally enforceable standards of care for “cyber-physical device security.” This article explores this underdeveloped area of academic inquiry into cyber-physical device security within the context of product liability litigation in the United States. The two questions addressed in this article are: (1) Have there been any successful products liability court decisions in the United States that have held IoT manufacturers liable for …

Digital Marketing And The Culture Industry: The Ethics Of Big Data, Jonathan Michael Bowman May 2021

Digital Marketing And The Culture Industry: The Ethics Of Big Data, Jonathan Michael Bowman

Graduate Theses and Dissertations

Instead of the steady march of the one percent growth in ecommerce as compared to total retail revenues in the last decade (to comprise about nine percent of the industry at the close of 2019), we have witnessed leaps now to over twenty percent in just the last year. Scott Galloway marks the pandemic as an accelerant not just of digital marketing posting a year of growth for each month of quarantine but as an accelerant of each major GAFA (Google, Amazon, Facebook, and Apple) firm from market dominance to total dominance (Galloway 2020). Viewing these trends from the standpoint …

A Tale Of Two Companies: The Importance Of Public Relations Amidst The Shift Towards Corporate Activism, Olivia Schwab Apr 2021

A Tale Of Two Companies: The Importance Of Public Relations Amidst The Shift Towards Corporate Activism, Olivia Schwab

Honors Theses

By comparing the controversies that stemmed from Papa John’s John Schnatter and CrossFit’s Greg Glassman, some obvious public relations strategies stand out, including but not limited to understanding an audience, adapting to a changing environment, establishing a crisis communications plan, and taking controversial stands on issues close to the audience’s hearts. Most importantly though, if companies preach messages of social change, they must follow up on their stances with corrective action to do their best to help facilitate it in society.

While examining the history of corporate activism, it is clear why and how some corporations become the victims of …

Implicit Communication And Enforcement Of Corporate Disclosure Regulation, Ashiq Ali, Michael T. Durney, Jill E. Fisch, Hoyoun Kyung Jul 2020

Implicit Communication And Enforcement Of Corporate Disclosure Regulation, Ashiq Ali, Michael T. Durney, Jill E. Fisch, Hoyoun Kyung

All Faculty Scholarship

This study examines the challenge of implicit communication -- qualitative statements, tone, and non-verbal cues -- to the effectiveness of enforcing corporate disclosure regulation. We use a Regulation Fair Disclosure (Reg FD) setting, given that the SEC adopted the regulation recognizing that managers can convey non-public information privately not just through explicit quantitative disclosures but also through implicit communication. In a high-profile enforcement action, however, the court focused on a literal examination of the manager’s language rather than his positive spin to conclude that the SEC had been “too demanding” in examining the manager’s statements and that its enforcement policy …

Walmart's Opioid Stewardship Initiative Rhetorically Constructed As An Act Of Corporate Social Responsibility, Rachel Kaplan Jul 2020

Walmart's Opioid Stewardship Initiative Rhetorically Constructed As An Act Of Corporate Social Responsibility, Rachel Kaplan

Speaker & Gavel

Walmart is the largest publicly owned retailer in the world (Fishman, 2008). Walmart operates in a contested rhetorical environment because of an aggressive pricing strategy, low-paying wages, and discrimination claims made by women. This paper argues Walmart created several Corporate Social Responsibility (CSR) programs to help improve corporate image and reputation. CSR encourages companies to consider a triple bottom line: people, the environment and profit. Consumers who practice socially responsible consumption choose to support companies they perceive give back to the community, participate in CSR initiatives to help people, and incorporate sustainable practices into the lifecycle of their products. This …

Thomas Kent's Paralogic Rhetoric As A Framework For Analyzing Corporate Social Responsibility Discourse, Donald E. Penner May 2020

Thomas Kent's Paralogic Rhetoric As A Framework For Analyzing Corporate Social Responsibility Discourse, Donald E. Penner

English Department Theses

Corporate social responsibility (CSR) scholarship increasingly uses rhetorical theory as a method for analyzing contested meaning between communicants. However, the classical and social constructivist rhetorical theories typically used for analysis do not address the primary cause of contested meaning – relativism. Conversely, such theories often contribute to a dualistic worldview by utilizing internally imagined conceptual schemes for analyzing texts. This thesis proposes Thomas Kent’s paralogic rhetorical theory as an alternative method of analyzing CSR texts, and focuses on three common areas typically utilized in rhetorical analyses of CSR texts: text reception, the rhetorical situation, and genre. Where paradigmatic rhetorical theories …
