In this paper, we will analyse the issue of concurrence between competition and sector rules and the relation between parallel concepts within the two different legal frameworks. This paper presents the conceptual path followed by European Union, European Commission and European Competition Network, after the Energy Sector Inquiry (2007) towards the realisation of the objective of an Energy Internal Market, fully functional and open to competition. Firstly, we examine the findings of Sector Inquiry and then we describe how the Third Energy Package - that followed - tried to address the issues highlighted by the Inquiry and how Third Energy Package introduces a promising but complex system, in order to develop sector rules. This paper examines management contracts as a paradigm for the application of relational contracts theory and especially of the theory of contractual and relational norms. This theory, deriving from Macauley's implications, but structured and analysed by I.R. MacNeil gives us a framework for the explanation and understanding of contractual obligations and business relations' rules and practice. The widespread partnering phenomenon in the US and the UK spurred a significant amount of literature focusing on its strategic use. The Politics of Partnerships diverges by examining if partnerships can deliver benefits that extend beyond the organisational to the societal level resulting from the intentional combined efforts of the partners. Based on the articles that have appeared in the period 1998- mid 2009, it can be concluded that the attention by newspapers is not only of the most recent years. De financieel-economische crisis heeft het debat over de wijze waarop we onze economie moeten organiseren opnieuw aangewakkerd. Brede lagen van de bevolking, het maatschappelijk middenveld en zelfs de politieke klasse gingen op zoek naar alternatieven voor ons economisch bestel. Eén van deze alternatieven is de coöperatie. Het loont daarom eens de moeite om te kijken in welke domeinen men deze organisatievorm (her)ontdekt heeft en of de coöperatie daadwerkelijk een alternatief kan vormen voor bepaalde sociale en economische problemen.

In de loop van 2009 werd aan het HIVA – Onderzoeksinstituut voor Arbeid en Samenleving (KULeuven) in de schoot van het Steunpunt Werk en Sociale Economie een monitor voor de sociale inschakelingseconomie opgesteld (Deraedt & Van Opstal, 2009a, b). Het ontwerp van deze monitor volgt daarbij de conceptualisering van de sociale economie, zoals eerder uitgewerkt in een technisch voorrapport door Gijselinckx & Van den Broeck (2008). As a response to the “junk-debt”- inspired, global, economic crisis, governments, with supra-national organizational approval, have appropriated billions of taxpayers’ dollars for bail-outs, have set-up special funds and under-written depositors’ savings in the desperate hope of alleviating the threat of rapid, economic decline and systemic destruction of value. Whether these governments have a democratic mandate for such unprecedented action is debatable. More importantly, though, is whether such decisions amount to good re-regulatory policy.

De sociale economie hanteert in ons land hoofdzakelijk het vzw-statuut en bestaat traditioneel ook uit (erkende) coöperatieve vennootschappen. In 1995 werd hier ook de vennootschap met sociaal oogmerk aan toegevoegd. In dit artikel bespreken we enkele randvoorwaarden voor een geslaagd ontwerp en een succesvolle implementatie van juridische kaders voor de sociale economie. Vervolgens bespreken we bondig de essentiële kenmerken van deze drie juridische kaders. We besluiten met een vergelijkende analyse en belichten daarbij de belangrijkste relatieve troeven en zwaktes ten opzichte van elkaar.

Corporate support for the not-for-profit sector has been underestimated by many companies as a highly effective strategy to develop brand awareness, attract and retain top staff and build social capital. Some top australian companies have understood this and have well developed partnerships with the not-for-profit sector leading to mutually beneficial outcomes and positive societal impacts. In-depth interviews and case studies support this.
