Work Made For Hire – Analyzing The Multifactor Balancing Test, Ryan G. Vacca
Work Made For Hire – Analyzing The Multifactor Balancing Test, Ryan G. Vacca
Law Faculty Scholarship
Authorship, and hence, initial ownership of copyrighted works is oftentimes controlled by the 1976 Copyright Act’s work made for hire doctrine. This doctrine states that works created by employees within the scope of their employment result in the employer owning the copyright. One key determination in this analysis is whether the hired party is an employee or independent contractor. In 1989, the U.S. Supreme Court, in CCNV v. Reid, answered the question of how employees are distinguished from independent contractors by setting forth a list of factors courts should consider. Unfortunately, the Supreme Court did not give further guidance on …

Ngos Creatively Navigating Donor And Governmental Restrictions In The Middle East And North Africa, Jessica David
Honors Theses and Capstones
Local governments’ regulations and donor organizations’ requirements create political and financial restrictions for Non-Governmental Organizations (NGOs) in the Middle East and North Africa (MENA). As a result NGOs in countries such as Egypt, Tunisia, and Morocco must become creative in the ways they develop and implement projects. In order to be efficient and successful, NGOs use different techniques including creative means to fund their programs, partnerships with outside organizations, and creative uses of their resources.
Many NGOs will find creative solutions to navigate these restrictions. Some of the solutions will be similar, while others will be completely unique. Yet despite …

A Growing Sin-Dustry: The History And Effects Of Cigarette Excise Taxation And Regulation In The United States, Devin A. Rheaume
Honors Theses and Capstones
Originating with the gabelle taxes of France during the close of the Albigensian Crusades, excise taxes and regulations on consumer products have historically been used by local and federal governments to generate revenue during periods of war. Following the enactment of the Internal Revenue Act on June 30, 1864, the United States extended their definition of consumer products to include cigarettes and other tobacco products. The United States Federal government justifies cigarette taxes as a method not only to discourage the habit of smoking but also to recover the costs of the negative externalities associated with the “sinful” behavior. Through …

Abstract— Tourism, like other developed industries is a commerce that requires energy inputs and yields outputs with significant effects on the environment. However a comprehensive study examining the life cycle impact associated with each tourism component including transportation, accommodation, food services, and recreation is still lacking. Therefore a search of previous tourism life cycle studies was carried out and ten studies were further investigated. Indicators, assessment approaches, and system boundaries of these previous studies were assessed. Then the outcomes were normalized and compared in order to obtain ranges for the four components of tourism. It was found that energy intensity …

That hole is to be the home of the Spire, the tallest building in the Northern Hemisphere, at 2,000 feet high with 1,194 residences ranging in price from $750,000 for a studio to $40 million for the penthouse. The developer, Shelbourne Development Group, Inc., began construction in 2007 using its own funds.
