Regional Trade Agreements And Compliance To Wto Rules, Kevin Dalglish P.
Regional Trade Agreements And Compliance To Wto Rules, Kevin Dalglish P.
Kevin Dalglish P.
The multilateral trading system existed first as the GATT from 1947 to 1994 and then as the WTO since 1995. Regional Trade Agreements (“RTAs”), defined as “a free-trade agreement, customs union or common market consisting of two or more countries” , however, began coming into their own only in the 1990s. Before that, there were virtually no such agreements until 1970 and less than 50 in 1990. This suggests that greater reduction in trade barriers (both tariff and non-tariff) was achieved in the earlier rounds of the GATT, which precluded the need for countries to resort to RTAs. Once, however, …

Standing order operations by the bank is a system by which customers instruct the bank to make systematic payments on behalf of the customer to a third party. This arrangement must be control and managed by the customer. The customer must have the sole right to cancel this arrangement from his bank at any time he wishes. Unfortunately however, this is not the situation with some banks in Ghana. In this article we outline an experience of a customer of Ecobank regarding the operation of standing order.

This description of the crime that Chase participates in as it proceeds with its foreclosure activities is necessary because the banking industry is misleading the judicial system about important financial aspects of today’s home loan mortgages. This is an initial attempt to describe the crime, including references to La Cosa Nostra and the crime families.

The spate of global scandals and corporate misadventures that began with the energy giant, Enron in the years 2000 to 2002, the Asian Financial Crisis of 1997/98, and the global Financial Meltdown of 2008, rocked the accountancy profession and sharply drew attention to the need for the profession to re-invent itself and re-define its focus in the new millennium. Accounting practitioners world-wide, have tested the limits of creative accounting, and the verdict of the marketplace is that the era of sharp and unwholesome practices are over for good. Part of the professional response to challenge of this era, is the …

This discussion highlights informed interaction between two knowledgeable parties about whether the residential mortgage asset backed securitization process involves the creation of an insurance product. Although an initial conclusion reached by an Insurance Examiner that it is not “insurance,” that same Examiner opened the door that it could be viewed as “insurance.” If it is determined that insurance is involved, the obligation to collect taxes falls onto the Connecticut State Department of Revenue Services, the requirement to collect balance sheets falls onto the Insurance Department, and the decision to prosecute originators for perpetuating a fraud on bank loan consumers falls …

This is the story of Chase1, the venerable old line bank, and how it used its dominant market influence in the decade leading up to 2012 to originate and acquire mortgage loans, how it forced individual homeowners to pay high rates, and how it ultimately began to steal the home equity away from hard-working homeowners and their families. It is also the story about how the largest US banks combined their anti-competitive behavior and took from residents in all States. As illustrated by the chain of events described below for a situation in Connecticut, Chase's attitude and actions never reflect …

There is no "default" in a securitized mortgage loan. The loan is paid off ab initio and the existence of the note is fabricated from paid off balances for the convenience of the originators who didn't think through the foreclosure process.

Why Do U.S. Securities Laws Matter To Non-U.S. Firms? Evidence From Private Class-Action Lawsuits, Amar Gande, Darius P. Miller
Amar Gande
A continuing controversy is whether U.S. securities laws are enforced against foreign firms, since public enforcement actions by the SEC are infrequent and often result in insignificant penalties. We examine private enforcement actions of U.S. securities laws and find that 269 securities class-action lawsuits were filed against foreign firms from 1996 to 2008. We document the severity of the penalties imposed on foreign firms and show that while firms paid a total of $9 billion to settle lawsuits brought against them, the monetary penalties levied by the market are even larger. During the three-day period surrounding the lawsuit filing date, …

(This material was prepared by a mortgage securitization geek but simplified to make it straightforward for smart people to understand. This material should be exciting for those who want to discover why the financial banking system no longer works. Mortgage securitization is about nuance. To understand what drives the actions of banks, and sometimes why regulators are missing the picture, many finer nuances of mortgage securitization must be understood. This Memorandum is an attempt to identify common structural realities and the implication for business associated with those realities)

Relevance Of Discretionary Accruals Information (Dai) In Ohlson Model: The Case Of Mexico, Rocío Durán-Vázquez, Arturo Lorenzo-Valdés, Juan Manuel San Martín-Reyna
Journal of Entrepreneurship, Management and Innovation JEMI
This study applied the modified Jones´ model (1991) for selected companies of Mexico. This model aims to assess the impact of Discretionary Accrual Information (DAI) on financial reporting statements, in order to identify the value relevance of “earnings quality”. We applied methodological criteria of Chung et al (2005) and Mukit & Iskandar (2009). We analyzed financial information of the 35 stock included in the Index of Prices and Quotations (IPC) of the Mexican Stock Exchange (BMV) for the period 2000 to 2011. 19 companies met the specifications of the model, for 48 quarters of information. The analysis was done in …

Trust After The Global Financial Meltdown, P. Werhane, Laura Hartman, D. Bevan, K. Clark, C. Archer
Laura Hartman
Over the last decade, and culminating in the 2008 global financial meltdown, there has been an erosion of trust and a concomitant rise of distrust in domestic companies, multinational enterprises, and political economies. In response to this attrition, this paper presents three arguments. We propose that the stakes of violating public trust are particularly high in light of the asymmetry between trust and distrust; we identify a constellation of key barriers to overcoming distrust that companies face in the current environment; and we argue that, notwithstanding these challenges, these phenomena are not fatal and can be addressed through a holistic …

Dividend Policy As A Signaling Mechanism Under Different Market Conditions: Evidence From The Casablanca Stock Exchange, Omar Farooq, Siham Saoud, Samir Agnaou
Omar Farooq
Does the signaling value of dividend policy depend on market conditions? Do investors respond to dividend policy differently in different periods? This study answers these questions by using a sample of firms from the Casablanca Stock Exchange during the period between 2003 and 2007. We find a significantly negative relationship between dividend payout ratio and stock price volatility during the stable growth period. We also show a significantly positive relationship between dividend payout ratio and stock returns during the same period. However, this relationship turns insignificant during the high growth period. One of the reasons for our results may be …

Effect Of Corporate Governance Mechanisms On The Relationship Between Legal Origins And Cost Of Debt: Evidence From The Middle East And North Africa (Mena) Region, Omar Farooq, Mohamed Derrabi
Omar Farooq
How do differences in country-level governance and enforcement mechanisms affect firms? Using a large dataset from the MENA region, we document that differences in legal traditions translate into differences in cost of debt. Our results show that firms headquartered in the common law countries have lower cost of debt than firms headquartered in the civil law countries. Our results also show that bulk of the difference in cost of debt between firms headquartered across the two legal regimes can be explained by the corporate governance mechanisms. Our results have implication for firms in the civil law countries in a way …

Post-Citizens United: Using Shareholder Derivative Claims Of Corporate Waste To Challenge Corporate Independent Political Expenditures, William Alan Nelson Ii

The Supreme Court’s recent decision in Citizens United v. FEC allows companies to spend unlimited sums from their treasuries on advertisements that promote or oppose political candidates. This issue has taken the main stage in American politics, especially with the current Republican primary race and the Presidential election in November. This article discusses how shareholders may use derivative claims of corporate waste to challenge independent political expenditures that they believe are detrimental to the corporation. The article begins by discussing the history of the corporate waste doctrine and looks at the standard for pleading a claim of corporate waste. The …

Dodd-Frank, Securitization, And The Subprime Mortgage Crisis, Stephen P. Hoffman
Stephen P. Hoffman
There are few things more constant in life than the rise and fall of financial markets. When markets crash, however, we are forced to restore them while learning from our mistakes. In the wake of the recent subprime mortgage crisis, Congress has drastically but deservedly overhauled the regulation of financial markets in order to not only prevent such disasters in the future, but to help restore financial stability more quickly if and when they do occur. In this Paper, I provide a background of the events leading up to the most devastating financial crisis since the Great Depression, focusing on …
