In this paper we will examine the issue of ownership unbundling and forced divestiture remedies imposed in a series of recent competition law cases of the energy market - examined in other papers - in relation to the possible existence of a series of legal obstacles. These energy market decisions belong to a group of antitrust cases in which a structural divestiture remedy has been imposed under the provisions of Article 9 of Regulation 1/2003. Waldo’s predictions about the future for public administration describe five areas that would be problematic in the future: legitimacy, authority, knowledge, control, and confidence. Legitimacy includes not only that the government is legally legitimized but capable and focused on an intention to deliver the “good society.” Authority, according to Waldo, is the ability to implement policy with the acceptance of the people based on rationalism, expectations of public good, ethics, superior knowledge, and institutional contexts. Hierarchies within organizations like the military have often contributed to feelings of subordination and have contributed to lower employee autonomy and a decrease in job satisfaction, motivation, and performance. Other constructs, such as those relating to personality, have been eluded to explain the variance in the poor outcomes. The overall scope of naval missions has remained largely unchanged despite the loss of more than 8,000 naval personnel each year since 2002. The downsized naval workforce experienced an overload in work assignments and an increase of health-related issues resulting in lowered morale, motivation, job satisfaction, and productivity. Maslow's theory of hierarchy of needs links personal satisfaction to work productivity, which is critical for naval personnel to protect national security, provide humanitarian services, and respond to international crises effectively. From 1996 to 2006, the number of Department of Defense (DoD) contract transactions increased, leading to over expenditures and the need for agencies to determine benefit estimation to improve risk management of a project. The purpose of this qualitative case study was to apply a total quality management theory to explore if a standardized versus decentralized benefits framework within the cost benefit analysis process could improve the Department of the Army acquisition selection process.
