Regulating New Tech: Problems, Pathways, And People, Cary Coglianese Dec 2021

Regulating New Tech: Problems, Pathways, And People, Cary Coglianese

All Faculty Scholarship

New technologies bring with them many promises, but also a series of new problems. Even though these problems are new, they are not unlike the types of problems that regulators have long addressed in other contexts. The lessons from regulation in the past can thus guide regulatory efforts today. Regulators must focus on understanding the problems they seek to address and the causal pathways that lead to these problems. Then they must undertake efforts to shape the behavior of those in industry so that private sector managers focus on their technologies’ problems and take actions to interrupt the causal pathways. …

How Did The Youth’S Demand For Cigarette Products Respond To The Sin Tax Reform Act Of 2012?, Francis Ignatius L. Nieva

Angelo King Institute for Economic and Business Studies (AKI)

The excise tax on tobacco products in the Philippines has been historically low making the product very accessible even for the youth. In 2012, a Sin Tax Reform Law was passed which increased the excise tax on tobacco products by almost five times its previous value. This price increase is projected to reduce alchohol and tobacco products consumption for all demographic classifications, especially the youth. This study estimated the price elasticity of cigarette demand of the Filipino youth using regression analyses on the pooled Global Youth Tobacco Survey conducted in the Philippines for the years 2004 and 2015. Price elasticity …

Dentistry And The Law: Unreasonable Non-Compete And Damages Provisions In Employment Contracts, Dan Schulte Jd Apr 2021

Dentistry And The Law: Unreasonable Non-Compete And Damages Provisions In Employment Contracts, Dan Schulte Jd

The Journal of the Michigan Dental Association

Non-compete and liquidated damages clauses in dental employment contracts must adhere to specific limits for enforceability. Courts require reasonable geographic and temporal constraints on non-competes, typically within patient-served areas under two years. Liquidated damages should reflect actual losses, especially in cases where damages are difficult to gauge. Courts may still reject these provisions if they find breaches or inequity. Employers are advised to strike a balance between safeguarding their interests and fostering positive work environments.

The Journal of the Michigan Dental Association

Artificial Intelligence (AI) is revolutionizing dental practice through its ability to process vast amounts of data, enhance diagnosis, and improve patient care. However, AI introduces the challenge of bias and ethical considerations. Dentists and dental benefit providers are utilizing AI for early disease detection and efficient data management, but transparency and fairness in AI algorithms are vital. The Rome Call for AI Ethics emphasizes ethical, non-biased AI development. In the broader context, AI-driven marketing and predictive behavior raise concerns about privacy and ethical data use. The dental community must embrace AI's power while upholding ethical standards and transparency.

A Public Option For Employer Health Plans, Allison K. Hoffman, Howell E. Jackson, Amy Monahan Feb 2021

A Public Option For Employer Health Plans, Allison K. Hoffman, Howell E. Jackson, Amy Monahan

All Faculty Scholarship

Following the 2020 presidential election, health care reform discussions have centered on two competing proposals: Medicare for All and an individual public option (“Medicare for all who want it”). Interestingly, these two proposals take starkly different approaches to employer-provided health coverage, long the bedrock of the U.S. health care system and the stumbling block to many prior reform efforts. Medicare for All abolishes employer-provided coverage, while an individual public option leaves it untouched.

This Article proposes a novel solution that finds a middle ground between these two extremes: an employer public option. In contrast to the more familiar public option …

Pandemics, Paid Sick Leaves, And Tax Institutions, Alex Zhang

Faculty Articles

The COVID-19 pandemic is currently ravaging the world, and the United States has been largely unsuccessful at containing the coronavirus. One long-standing policy failure stands out as having exacerbated the pandemic in our country: the lack of a national mandate of paid sick leaves, without which workers face financial and workplace-cultural pressures to attend work while sick, thus spreading the virus to their fellow employees and the public at large.

This Article provides the blueprint for a national, subsidized mandate of paid sick leaves and two additional insights about our tax institutions as mechanisms of effectuating broader societal goals. It …
