Managing Foreign Corrupt Practices Act Risks Of Gift, Travel And Entertainment Expenditures, Karl Boedecker

Significant increases in Foreign Corrupt Practices Act enforcement activities have heightened the legal risks associated with giving gifts or paying travel and entertainment expenses for U.S. firms when promoting their goods or services in foreign markets. This change in the external environment necessitates appropriate strategic adjustments and managerial actions. The lack of specific standards of conduct under the FCPA’s general prohibitions requires that U.S. firms closely monitor the increasing number of investigations and legal actions initiated by the U.S. Securities Exchange Commission and the U.S. Department of Justice.

Food Safety And The Role Of The Government: Implications For Csr Policies In China, R Dellios, Xiaohua Yang, N K. Yilmaz

This study investigates food scandals and the role of government in corporate social responsibility (CSR) in the food industry and explores strategies for the Chinese government to tackle the food safety problems that abound in China. Based on the theoretical discussion of four types of CSR and the empirical evidence from four case studies, we argue that government influence on CSR in the food industry is determined by the intensity and salience of its own behavior and actions including regulations. We further believe that a balanced CSR strategy covering economic, legal, ethical and philanthropic considerations would work best for China. …

The current financial crisis resonates with every American, regardless of their connection to the securities markets. Many struggle to understand how and why the American financial and securities markets collapsed last year. In essence, why did the regulators fail to prevent the collapse? Government officials continue to analyze the relationship between the structural collapse of the markets and regulators’ limited jurisdiction over a class of entities whose transactions substantially impact the markets: hedge funds. Marketing academics endeavor to conduct research that contributes to the development of cutting edge theories and ideas about marketing. At the same time, they try to incorporate these research findings into their classes through the application of theories to the practice of marketing. Even so, marketing scholarship comes under intermittent attack for being arcane and irrelevant for practitioners. To explore this disconnect between theory and practice, we review the evolution of scholarly research in marketing. We identify the various definitions of scholarship that have evolved as business schools have matured. We conclude that marketing academics must make scholarly contributions, variously …

The U.S. Supreme Court handed down its decision in BMW v. Gore (1996) in May. This decision triggered another round of discussions regarding restraints on punitive damages as a part of the overall reform of the U.S. tort system. Here, the authors review the BMW decision and its immediate predecessors to illustrate the essential public policy issues that are associated with proposed limits on punitive damages.

During the past 15 years, the U. S. Supreme Court has used Central Hudson Gas v. Public Service Commission (1980) to expand significantly the power of the government at all levels to regulate advertising and other promotional activities. As a result, first amendment protection for commercial speech has steadily diminished. In this article, Supreme Court decisions subsequent to Central Hudson are reviewed to provide an update of Cohen's (1978) work. Marketers of used products face uncertainty in the legal environment because of the inconsistent ways their offerings are treated with respect to strict product liability. The authors analyze the conceptual underpinnings of strict liability to assess its applicability to used goods. Then they examine litigated cases to present an overview of current judicial treatment of defective used products. Finally, they discuss policy issues related to used products in the context of both the law and marketing.

Salespeople can generate liability problems for their organizations through both intentional and inadvertent statements, yet the sales management and personal selling literature has not provided adequate discussion of these problems. The various intra-industry approaches by which a consumer can recover for injuries are reviewed in this article, and their implications for marketing are examined.
