This essay examines the similarities and differences between legal and other precepts outlining corporal punishment in ancient and medieval Indian and early medieval European laws. Responding to Susan Reynolds’s call for such comparisons, it begins by outlining the challenges in doing so. Primarily, the fragmented political landscape of both regions, where multiple rulers and spheres of authority existed side-by-side, make a direct comparison complex. Moreover, the time slippage between what scholarship understands to be the “early medieval” period in each region needs to be taken into account, particularly given the persistence of some provisions and the adapatation or abandonment of …

Toward A History Of Documents In Medieval India: The Encounter Of Scholasticism And Regional Law In The Smṛticandrikā, Donald R. Davis Jr.

In order to understand the legal use and significance of documents in medieval India, we need to start from the contemporaneous legal categories found in the Sanskrit scholastic corpus called dharmaśāstra. By comparing these categories with actual historical documents and inscriptions, we gain better insight into the encounter of pan-Indian legal discourse in Sanskrit and regional laws in vernacular languages. The points of congruence and transgression in this encounter will facilitate a nuanced history of documents and their use beyond unhelpfully broad categories of written and oral. The cultural construction of gender determines the role of women and girls within the family in many societies. Gendered notions of power in the family are often shrouded in religion and custom and find their deepest expression in Personal Laws. This essay examines the international law framework as it relates to personal laws and the commonality of narratives of litigators and plaintiffs in the cases from the three different personal law systems in India.

B. V. Narasimhaswami (1874–1956) never met Shirdi Sai Baba face to face, for he arrived in Shirdi eighteen years after Sai Baba’s death in 1918. However, the overwhelming sense of loving union he experienced in Shirdi convinced him that Sai Baba was still accessible from beyond the grave. For the remaining years of his life he worked relentlessly to spread Sai Baba’s name throughout India. This article examines the tension between inclusion and exclusion in Narasimhaswami’s interpretation of Sai Baba. Utilizing this celebrated declaration of the Rig Veda as an epigraph in his first scientific monograph, Response in the Living and Non-Living, (1902), the audacious Indian physicist Jagadish Chandra Bose (1858-1937) intimated to the Western scientific world that his electrographic discovery of the unity of life - that the animate and the inanimate world are one - was an affirmation of the insights of the ancient Vedic seers.

This work examines the role of religio-cultural resources in enabling the transformation of a broken community and people.
In the context of nineteenth and twentieth century British India, an oppressed community in India set out to explore the possibility of challenging and re-defining their own destiny. This oppressed section of Indians who lived in the margins of Indian caste defined society were considered socially and ritually polluting people and were subservient to various socio-economic and religio-cultural biases. The daily life routine of this oppressed community, called the Sambavars (Pariahs) of the Malayalam speaking princely State of Travancore in South India, …

The Unintended Legacy Of Hellenism: The Development And Dissemination Of The Buddha Image, Chukyi Kyaping

This paper traces the development and evolution of the Buddha image from the first century CE in Gandhara to the fifth century CE in Luoyang, China and discusses the circumstances that allowed the image to adapt to different cultural environments. The emergence of the Buddha image marked a significant shift in the perception of the Buddha himself, through which Buddhism had effectively transformed from a philosophy into a religion.
Due to the syncretic nature of the Gandhari region, the Buddha image incorporated elements from multiple cultures, most notably from the Hellenistic artistic tradition. The dissemination of the Buddha image, traced …

This dissertation aims to provide an understanding of the historical and contemporary dynamics of India’s foreign policy towards Israel within the context of religious identity from 1947 to 2015. A historical analysis of the relationship between India and Israel exhibits the ways that religious identity has served as a primary factor impeding as well as facilitating relations between the two nations.

As a secular democracy, India’s constitution enshrines relatively robust safeguards for religious equality and freedom. Article 25 provides all citizens the right to “freely profess, practice, and propagate” religion, and avoids assigning to Hinduism any special role or explicit privilege (in contradistinction to the situation with Buddhism in Sri Lanka, for example). Moreover, the Indian government itself has not generally engaged in any systematic or flagrant way in the direct persecution or oppression of its religious minorities.
However, India’s religious minorities do face certain challenges. Among them are several legal and judicial issues. Judicial rulings in independent India have weakened …

As an anti-corruption journalist in Afghanistan, Aarash’s family’s life was threatened by warlords. His car was shot at, their guesthouse was bombed, and later when they were threatened at gunpoint, they tried to make a new life in India. But in India, they discovered difficulties in obtaining permanent visas so they had return to Kabul where they hid at a friend’s house for 20 days while obtaining documentation to flee to Turkey. Because women encounter unique geographic, social, political, religious, economic, and temporal conditions, applying the particular agendas of traditional western feminism to countries like India can easily become a form of cultural imperialism or lead to Orientalism. Therefore, in this essay I argue that in order to support the agency of Indian women, western feminists must step back; Indian women and men who seek women's uplift must claim post-patriarchal expressions of traditional Indian culture. Tradition does and should inform modern culture. However, Indian women's uplift movements and western feminism alike must utilize both ancient and modern wisdom in our quest for …

Towards A Connected History Of Equine Cultures In South Asia: Bahrī (Sea) Horses And “Horsemania” In Thirteenth-Century South India, Elizabeth Lambourn

This article explores ways that the concept of equine cultures, developed thus far principally in European and/or early modern and colonial contexts, might translate to premodern South Asia. As a first contribution to a history of equine matters in South Asia, it focuses on the maritime circulation of horses from the Middle East to Peninsular India in the thirteenth century, examining the different ways that this phenomenon is recorded in textual and material sources and exploring their potential for writing a new, more connected history of South Asia and the Indian Ocean world.

Letters written by Jahue Louis Piercy, a Methodist minister from Barren County, Kentucky, to his sister and brother-in-law, Louis D. “Den” and Minnie Florence Barbour, of Eighty Eight, Kentucky. He writes while on a year-long world evangelism tour with Henry Clay Morrison. Two of the letters are sent from India and one from Naples, Italy. He describes the geography and culture of India.
