For many years copyright was a backwater of the law. Perceived as an esoteric and narrow field beset by hypertechnical formalities, the discipline and its practitioners were largely isolated from scholarly and case law developments in other areas. There were exceptions of course. Well before the explosion of intellectual property litigation in the last twenty years, persons such as Zcharia Chaffee Jr. and Judge Learned Hand brought a wealth of learning and a broad perspective to copyright.

Virtually all the issues canvassed above embody the tension that exists in seeking to honor the interests of two generations of creators. For example, the essay has discussed the need for new adaptive artists to have a copyright in their own productions and the dangers that the "subconscious copying rule" poses to new creators, particularly in an age of ubiquitous media.

Establishing The Phenomenon: The Rhetoric Of Early Research Reports On Aids, Carol Reeves

In the first three medical reports on AIDS which were published in 1981 in the New England Journal of Medicine, the writers' primary rhetorical agenda was to argue that a new medical discovery had been made. A secondary agenda was to offer etiological explanations for the new problem. To establish the new disease entity as deserving serious attention, the writers built a sense of mystery by confronting established medical knowledge about immunodeficiency and emphasizing the inability of modern medicine to diagnose and treat the problem. Hence the question: Are these good or bad times for liberalism? To answer, we shall need a broader perspective than a survey of contemporary developments can provide. We shall need to look back, that is, to see what liberalism was in order to understand what it has become. Only then can we assess its current condition and prospects-and appreciate how politics in the United States is largely an intramural debate between different wings of liberalism.

John Rawls, The Conception Of A Liberal Self, And The Communitarian Critique, Johnathan Edward Mansfield

John Rawls' A Theory of Justice stands as the single most important work in the Anglo-American liberal tradition after World War II. In A Theory of Justice, Rawls revives the social contract doctrine in order to determine principles of justice that would be chosen by persons who are free and equal moral individuals. Since Rawls believes that no single conception of the good can establish justice in a pluralistic society, he posits a set of principles of right which are prior to any particular good. Thus his theory, which he calls "justice as fairness," is deontological. Since its publication in …
