This chapter reviews a range of topics connected to the justification of government regulation, including: the definition of “regulation”; welfarism, Kaldor-Hicks efficiency, and the Pareto principles; the fundamental theorems of welfare economics and the “market failure” framework for justifying regulation, which identifies different ways in which the conditions for those theorems may fail to hold true (such as externalities, public goods, monopoly power, and imperfect information); the Coase theorem; and the different forms of regulation.

Starting with the Data-Information-Knowledge-Wisdom paradigm in information science it is possible to derive a model of the opposite of knowledge having hierarchical qualities. A range of counterpoints to concepts in the knowledge hierarchy can be identified and ascribed the overall term “nonknowledge.” This model creates a conceptual framework for understanding the connections between topics such as error, ignorance, stupidity, folly, popular misconceptions, and unreason by locating them as levels or phases of nonknowledge. The concept of nonknowledge links heretofore disconnected discourses on these individual topics by philosophers, psychologists, historians, sociologists, satirists, and others. Brain‐Mind And Structure‐Function Relationships: A Methodological Response To Coltheart, Adina L. Roskies

In some recent papers, Max Coltheart has questioned the ability of neuroimaging techniques to tell us anything interesting about the mind and has thrown down the gauntlet before neuroimagers, challenging them to prove he is mistaken. Here I analyze Coltheart’s challenge, show that as posed its terms are unfair, and reconstruct it so that it is addressable. I argue that, so modified, Coltheart’s challenge is able to be met and indeed has been met. In an effort to delineate the extent of neuroimaging’s ability to address Coltheart’s concerns, I explore how different brain structure‐function relationships would constrain the ability of …

Although the term “cosmopolitan-communitarian debate” never really caught on, a national-global fault line remains prominent in debates about global justice. “Dialogic cosmopolitanism” holds the promise of bridging this alleged fault line by accepting many of the communitarian criticisms against cosmopolitanism and following what can be described as a communitarian path to cosmopolitanism. I want to use this opportunity to discuss a phenomenon that continues to plague the human experience. It is called the game of war. War is perhaps the deadliest game that humanity has created. The conflict itself represents what appears to be opposing views about the way things should be. Each side believes that it is right and that its actions are justified. Each side therefore seeks to impose its views on the other or to defend its views against the other. Each side fears the other as an enemy and each side projects its fears onto its perceived “enemy.”

Should we remain neutral between our interests and those of future generations? Or are we ethically permitted or even required to depart from neutrality and engage in some measure of intergenerational discounting? This Article addresses the problem of intergenerational discounting by drawing on two different intellectual traditions: the social welfare function (“SWF”) tradition in welfare economics, and scholarship on “prioritarianism” in moral philosophy. Unlike utilitarians, prioritarians are sensitive to the distribution of well-being. They give greater weight to well-being changes affecting worse-off individuals. Prioritarianism can be captured, formally, through an SWF which sums a concave transformation of individual utility, rather …

This paper demonstrates the broad appeal and usefulness of the political and legal thought of Carl Schmitt to scholars of international relations by applying his seminal friend-enemy antithesis to current global problems as well as to current IR theories used to negotiate them. I argue that Schmitt’s contemporary appeal lies, first, in his insistence that collective identity is necessarily formed through conflict (enmity); and second, that identity lies at the very base of what motivates behavior on the international stage (at the sub-national, national and transnational levels). By implication, Schmitt’s theories offer some fresh insights into the sources and nature …

When exercising their public health powers, states claim various rights against their subjects and aliens. The paper considers whether public health considerations can help justify some of these rights, and explores some constraints on the justificatory force of public health considerations. I outline two arguments about the moral grounds for states’ rights with regard to public health. The principle of fairness emphasizes that those who benefit from public health measures ought to contribute their fair share in upholding them. Alternatively, states’ rights might be justified by a natural duty of justice to uphold and not to obstruct institutions implementing public …

journal, of transpersonal systems that fail to discriminate between nirvanic, samsaric, and neithernirvanic-

nor-samsaric transpersonal states, and which present the absolute sanity of Awakening

as a dualistic, conceptually-tainted condition. It also gives continuity to the denunciation of the

false disjunction between ontogenically ascending and descending paths, while showing the truly

significant disjunction to be between existentially ascending and metaexistentially descending paths.

The purposes of this historical study were to 1) document the Selfethnic Liberatory adult education nature and goals of the poetry of Langston Hughes (from 1921 to 1933); and 2) to document the impact this poetry had on members of the African Diaspora. In addition, the goal of this research was to expand the historical knowledge base of the adult education field, so that it is more inclusive of the contributions of African Americans.

Quest For Quotidian: A National Survey Of Non-Heterosexual Attitudes Toward Marriage, Troy A. Mcginnis

Marriage equality remains a legal impossibility for same-sex couples in most states, and opponents are concerned that expansion of marriage to include gays and lesbians would radically redefine the institution. Findings from an online survey of lesbians, gays and bisexuals— a non-random sample of 466 adult men and women age 18 to 74 in 37 states— strongly suggest that many non-heterosexuals' attitudes reflect neither a radical departure from core definitions of marriage, nor a rejection of traditional "family values," but instead signal an assimilationist position favorable to traditional marriage norms rather than a liberationist position critical of the institution.

The first major revision of the ACA Code of Ethics in a decade occurred in late 2005, with the updated edition containing important new mandates and imperatives. This article provides interviews with members of the Ethics Revision Task Force that flesh out seminal changes in the revised ACA Code of Ethics in the areas of confidentiality, romantic and sexual interactions, dual relationships, end-of-life care for terminally ill clients, cultural sensitivity, diagnosis, interventions, practice termination, technology, and deceased clients.

Copyright law’s principal justification today is the economic theory of creator incentives. Central to this theory is the recognition that while copyright’s exclusive rights framework provides creators with an economic incentive to create, it also entails large social costs, and that creators therefore need to be given just enough incentive to create in order to balance the system’s benefits against its costs. Yet, none of copyright’s current doctrines enable courts to circumscribe a creator’s entitlement by reference to limitations inherent in the very idea of incentives.
