In popular consciousness and culture, equality is often considered to be the preeminent socialist value. Equality, on this view, sits at the heart of the socialist ideal, and those who ascribe great value to equality will, other things being equal, find themselves more predisposed towards socialism than those who do not. However, in recent years egalitarian accounts of the socialist ideal have increasingly come under criticism from defenders of an alternative, freedom-based approach to understanding the values that underpin socialist commitment. Merit And Inequality: Confucian And Communitarian Perspectives On Singapore's Meritocracy, Sor-Hoon Tan

This paper compares criticisms of Singapore’s meritocracy, especially against its impact on income disparities and class divisions, with Michael Sandel’s critique of the meritocratic ethic in the United States. Despite significant differences in their history and politics, meritocracy has similar dysfunctions in both societies, allowing us to draw theoretical conclusions about meritocracy as an ideal of governance. It then contrasts Sandel’s communitarian critique of meritocracy with recent Confucian promotion of political meritocracy and meritocratic justice and argues that the Confucian principle of “promoting the virtuous and talented” is different from the contemporary conception of meritocracy. For Axel Honneth, not all social problems can be understood as injustices. Therefore, he introduces the additional diagnostic concept of social pathology. In his book Freedom’s Right (FR), it is defined as an accumulation of persons’ inability to adequately participate in social institutions due to misunderstanding them. In contrast, injustices consist in the denial of access to social institutions for certain groups. According to the aim of presenting an ‘extended’ theory of justice in FR, Honneth intends to reconstruct all institutions necessary for realizing individual freedom in a liberal-democratic society. Art changes culture while policy codifies it. Radical revolutionary movements are often accompanied by equally radical shifts in art and design. I cataloged, compared, and contrasted the semiotic power of three specific symbols and their most significant historical moments in the United States. Against Identity: A Positionalist Approach To Resisting Identity-Based Violence, Barbara Walkowiak

I develop and defend a positionalist theory of identity as a basis from which to resist identity-based violence. On this account, identities are the social positions that individuals occupy due to belief that operate upon them. This contrasts with and is intended to replace the dominant intrinsicist model, which conceives of identity as something about individuals in and of themselves. Taking gender as a focal point, I develop three overarching positionalist kinds: monogyne, polygyne, and androgyne. I propose that additional sub-kinds (e.g. monogyne woman) be developed in order to more exactly track gender positionalities and the operational beliefs that produce …

Righting Health Policy: Bioethics, Political Philosophy, And The Normative Justification Of Health Law And Policy, D. Robert Macdougall

In Righting Health Policy, D. Robert MacDougall argues that bioethics needs but does not have adequate tools for justifying law and policy. Bioethics’ tools are mostly theories about what we owe each other. But justifying laws and policies requires more; at a minimum, it requires tools for explaining the legitimacy of actions intended to control or influence others. It consequently requires political, rather than moral, philosophy. After showing how bioethicists have consistently failed to use tools suitable for achieving their political aims, MacDougall develops an interpretation of Kant’s political philosophy. In this dissertation, I offer an interpretation of Aristotle’s account of friendship thatemphasizes the importance of fairness in understanding the connection that he draws between friendship and justice. Many contemporary interpretations of Aristotle conclude either that the connection between friendship and justice is primarily relevant in the context of political friendship or is primarily a concern for friendships between virtuous individuals. Such interpretations, however, tend to diminish the importance of friendships on account of usefulness and pleasure in Aristotle’s account, as well as the importance of friendships in associations other than the political association.

Canadian courts have struggled with delay for decades. The advent of the COVID-19 pandemic added to an already difficult situation. Courts were required to take swift action, which they did. Despite this, they have faced criticism concerning the approach taken. I will argue that this criticism is not warranted and has more to do with the perceptions of the courts’ past performance than it has to do with their response to the pandemic. Regardless, the systemic delay in Canadian courts has become an issue of ethics which overshadows any success they have had in the current pandemic.

John Rawls’ influential A Theory of Justice presents a liberal theory in which individuals gain “a sense of justice” that commits them to the success of the just society above other interests or life plans. Critics of Rawlsian liberalism such as Taylor, Sandel, MacIntyre, Walzer, and the communitarians have variously complained that his theory inadequately accounts for individual commitment to community as distinct from commitment to the whole of society. But none of the leading theories offers a comprehensive account of the nature and function of rights that both stands up under the pressure of counterexamples and can buck accusations of internal inconsistency.

Throughout the process of writing this thesis, I have struggled with whether or not to use the term “gender abolition.” In one sense, the term itself initially piqued my interest in the topic. I remember the first time I heard of gender abolition, I had an immediate intuitive resistance. The article focuses on a troubling aspect of contemporary judicial morality.
Impartiality—and the appearance of impartiality—are the foundation of judicial decision-making, judicial morality, and the public’s trust in the rule of law. Recusal, in which a jurist voluntarily removes himself or herself from participating in a case, is a process that attempts to preserve and promote the substance and the appearance of judicial impartiality. Nevertheless, the traditional common law recusal process, prevalent in many of our state court systems, manifestly subverts basic legal and ethical norms.

In this dissertation, I advance a novel eco-political theory of territory that grounds a people’s territorial rights in its right to political self-determination understood as inextricably and normatively bound up with its right to ecological integrity and duty of ecological sustainability. I develop a social ontology of the people as the holder of territorial rights based on its members’ place-based common activities that aim at their own independent governance rather than in terms of state institutions, cultural nationhood, ethnogeography, political identity, or shared conceptions of justice. In this thesis, I seek to provide a framework for developing nations making policy-decisions about legal rights, as in the realm of Rawlsian ideal theory, prescriptions for governments not living in conditions of moderate scarcity is lacking. I first springboard off Stephen Holmes and Cass R. Sunstein’s conclusion that “all legal rights are positive,” from their book, The Cost of Rights, to argue for the value of considering the economic implications of rights protections. This dissertation project focuses on G.W.F. Hegel’s early philosophical writings, though primarily on the Natural Law essay (1802/3), and how, through those writings, Hegel positions himself in relation to other thinkers, such as Fichte. Broadly, the modern period saw with it the rise of accounts of what is called natural law. Philosophers prior to Hegel argued that the proper account of natural law must be rooted in some kind of universal framework: either the basis of law must be the shared empirical facts of human nature (empiricism), or the basis of law must be found in the universal demands on …

Treves et al.’s target article can play an important role in reconciling the needs of future generations and non-human animals in conservation. Human capacities are adequate for interpreting and defining many non-human animal needs. Worldviews are more complex, however, and conservation science, like the target article itself, suffers from a lack of diversity and inclusiveness. This may pose practical impediments to realizing just preservation.

Although there are existing philosophical accounts of útang-na-loób (debt of good will) and the suggestion that this Filipino cultural practice can be considered a virtue is not new, questions remain about how morally desirable forms of útang-na-loób can be separated from its problematic involvement in nepotism, patronage politics, life-long servitude, corruption, and other forms of injustice. In this paper, I develop a practical and empirically grounded account of útang-na-loób as a Filipino virtue by using a neo-Aristotelian framework that allows for the incorporation of research from the social sciences into virtue-theoretic recommendations for action. The Subversions And Perversions Of Shadow Vigilantism, Paul H. Robinson, Sarah M. Robinson

This excerpt from the recently published Shadow Vigilantes book argues that, while vigilantism, even moral vigilantism, can be dangerous to a society, the real danger is not of hordes of citizens, frustrated by the system’s doctrines of disillusionment, rising up to take the law into their own hands. Frustration can spark a vigilante impulse, but such classic aggressive vigilantism is not the typical response. More common is the expression of disillusionment in less brazen ways by a more surreptitious undermining and distortion of the operation of the criminal justice system.

Martha Nussbaum’s work Political Emotions: Why Love Matters for Justice identifies the role that compassion plays in motivating citizens in a just society. I expand on this discussion by considering how attitudes of indifference pose a challenge to the extension of compassion in our society. If we are indifferent to others who are in situations of need, we are not equipped to experience compassion for them. Building on Nussbaum’s account, I develop an analytic framework for the public emotion of Civic Tenderness to combat indifference.
