Developing Capabilities: A Feminist Discourse Ethics Approach, Chad Kleist

This dissertation attempts to preserve the central tenets of a global moral theory called “the capabilities approach” as defended by Martha Nussbaum, but to do so in a way that better realizes its own goals of identifying gender injustices and gaining cross-cultural support by providing an alternative defense of it. Capabilities assess an individual’s well-being based on what she is able to do (actions) and who she is able to be (states of existence). Nussbaum grounds her theory in the intuitive idea that each and every person is worthy of equal respect and dignity. The problem with grounding a theory …

Nature, Feminism, And Flourishing: Human Nature And The Feminist Ethics Of Flourishing, Celeste D. Harvey

This dissertation examines the viability of a feminist ethic of flourishing. The possibility of a eudaimonist, or flourishing-based, ethic adapted for the needs of feminist ethics and politics has recently been raised by a number of feminist moral philosophers. However, in these discussions, the degree to which an ethic of flourishing requires a substantive conception of human nature has not been adequately addressed. Flourishing-based ethical theories appear to require a substantive account of the kind of thing whose flourishing is to be promoted, while contemporary academic feminism is characterized by a strong suspicion toward claims about human nature. Embodying A "New" Color Line: Racism, Anti-Immigrant Sentiment And Racial Identities In The "Postracial" Era, Grant J. Silva

This essay explores the intersection of racism, racial embodiment theory and the recent hostility aimed at immigrants and foreigners in the United States, especially the targeting of people of Latin American descent and Latino/as. Anti-immigrant and anti-foreigner sentiment is racist. It is the embodiment of racial privilege for those who wield it and the materiality of racial difference for those it is used against. This manifestation of racial privilege and difference rests upon a redrawing of the color line that is meant towards preserving exclusive categories of political membership. Natural Law Theory And The "Is"--"Ought" Problem: A Critique Of Four Solutions, Shalina Stilley

This dissertation explores the "Is"--"Ought" problem (IOP) as it relates to natural law theory (NLT). It begins with a brief analysis of the type of "ought"--precepts upheld by traditional natural law theorists as well as a consideration of the precise nature of the IOP. Chapter two considers the attempts of Searle and Gewirth at establishing that it is possible validly to derive an "ought"--conclusion from "is"--premises and asks whether their attempts can be imitated successfully by those who wish to uphold the basic claims of NLT. Using Rights To Counter “Gender-Specific” Wrongs, Theresa Tobin

One popular strategy of opposition to practices of female genital cutting (FCG) is rooted in the global feminist movement. Arguing that women’s rights are human rights, global feminists contend that practices of FGC are a culturally specific manifestation of gender-based oppression that violates a number of rights. Many African feminists resist a women’s rights approach. They argue that by focusing on gender as the primary axis of oppression affecting the African communities where FGC occurs, a women’s rights approach has misrepresented African women as passive victims who need to be rescued from African men and has obscured the role of …

On Their Own Ground: Strategies Of Resistance For Sunni Muslim Women, Theresa Tobin

Drawing from work in feminist moral philosophy, Tobin argues that the most common methodology used in practical ethics is a questionable methodology for addressing practical problems across diverse cultural contexts because the kind of impartiality it requires is neither feasible nor desirable. She then defends an alternative methodology for practical ethics in a global context and uses her proposed methodology to evaluate a problem that confronts many Sunni Muslim women around the world.

The "colorblind" society is often offered as a worthy ideal for individual interaction as well as public policy. The ethos of liberal democracy would seem indeed to demand that we comport ourselves in a manner completely indifferent to race (and class, and gender, and so on). But is this ideal of colorblindness capable of fulfillment? And whether it is or not, is it truly a worthy political goal? The Non-Modularity Of Moral Knowledge: Implications For The Universality Of Human Rights, Theresa Tobin

Many contemporary human rights theorists argue that we can establish the normative universality of human rights despite extensive cultural and moral diversity by appealing to the notion of overlapping consensus. In this paper I argue that proposals to ground the universality of human rights in overlapping consensus on the list of rights are unsuccessful. I consider an example from Islamic comprehensive doctrine in order to demonstrate that apparent consensus on the list of rights may not in fact constitute meaningful agreement and may not be sufficient to ground the universality of human rights.
