A Constituição está acima de toda e qualquer outra manifestação jurídica, e, naturalmente, política. Por isso tem sido identificada, na pirâmide normativa (e jurídica em geral), com o vértice. Todo o Direito tem de estar de acordo com a Constituição. As normas, mesmo pretensamente constitucionais, que não respeitem a Constituição, são inconstitucionais e devem ser apagadas (quanto possível, pela natureza das coisas) da ordem jurídica. Modernity, Capitalism, And War: Toward A Sociology Of War In The Nineteenth Century, 1815-1914, Eric Royal Lybeck

The academic discipline of Sociology has rarely broached the subject of war and its recursive relationship with society. This paper addresses three major approaches in several disciplines that can be deemed ‘economically deterministic’: Marxist, Liberal, and Realist. These approaches can be useful for certain questions, but also leave out, or cloud other non-economic variables in understanding war – notably culture and military variables themselves. By using Karl Polanyi’s thesis regarding the “Myth of the Hundred Years’ Peace” (1815-1914) as a foil, the historical case of war in the nineteenth century is used to highlight the nature of war in European …

This paper aims to elaborate the tolerance discourse in Yogyakarta through restricted research pertaining that issue within the society of Yogyakarta. Since the beginning, the society of Yogyakarta has been practiced brotherhood, fraternity and tolerance in many ways. In early 1990s, however, some Islamist group has been growing at the city in which a number of Islamic schools and hospitals were built in some area in Yogyakarta. This dissertation focuses on the National Register of Historic Places and considers the geographical implications of valuing particular historic sites over others. Certain historical sites will either gain or lose desirability from one era to the next, this dissertation identifies and explains three unique preservation ethical eras, and it maps the sites which were selected during those eras. These eras are the Settlement Era (1966 – 1975), the Commercial Architecture Era (1976 – 1991), and the Progressive Planning Era (1992 – 2010). What governs state interests in development in formerly colonised societies? Conventional social science accounts stress politico-economic variables, particularly the need for capital accumulation. By means of a detailed analysis of the Bhadravati Iron Works, an ambitious industrial project in the state of Mysore in colonial India, it is demonstrated that mechanisms are also important in state-led development. Locational disadvantages, technical problems, and increased production costs made the iron plant an unprofitable venture from its inception. Remote, isolated, and nearly barren Schoodic Point, now the easternmost part of Acadia National Park, was long bypassed by early explorers and settlers. It might have seemed destined to remain deserted, a candidate for coastal parkland preservation in the twentieth century. But like such distant outposts as Vinalhaven, Swan’s, and Ironbound islands, Schoodic in the nineteenth century was overtaken by extensive land development, logging, and settlement by fishermen farmers. Eventually its proximity to Bar Harbor made it a target for vacation resort cottages. Immigration and otherness represent core concerns in contemporary society and, as such, give rise to debate and discussion in many disciplines. the question of otherness also arises as a recurrent and key subject in the field of literature. Tahar Ben Jelloun’s novel Partir is replete with the ambivalence of otherness: attraction/aversion; difference/similarity; lack/exile; native/foreigner; close/distant; normal/deviant and as such provides a laboratory where the expression of otherness in discourse can be dissected. In 1991, South African women’s organisations formed the Women's National Coalition (WNC) to identify and advocate for women's primary needs in the post-apartheid Constitution. The outcome of this advocacy was South Africa’s adoption, in 1996, of one of the most comprehensive protections of gender and sexuality rights of any national constitution. I argue that the WNC became a key actor in the development of the Constitution by drawing from a tradition of women’s organising in South Africa that emphasised women’s legitimacy in and value to public politics. The WNC rejected masculinist framings of politics and instead demanded that political structures …

The Mississippi Territory officially became part of the United States in 1798. The territory was to be governed under the rules of the Northwest Ordinance, but those who went to govern the area found a culture that required the use of common law to settle the disputes arising from prior governments under other nations. With no precedents on which to rely, disputes led, at first, to dueling and then to libel cases. Both common law and common sense prevailed while many of the disagreements were aired publicly in newspapers. Mississippi’s first printer, Andrew Marschalk, using his First Amendment rights, wrote …
