Questions about the appropriate rules and mechanisms of taxation are, first and foremost, questions concerning the nature of society. What can be taxed, what cannot, for what purpose, when, and how, are all matters that go to the heart of society and, in particular, concern society’s underlying beliefs and values vis-à-vis the meaning and attainment of justice. This Article explores the role of normative values and theory in tax policymaking. Al-Ijarah Al-Mawsufah Fi Al-Dhimmah (Forward Ijarah) is a new form of transactions introduced to the Islamic banking industry which has original ground in the classical books of Islamic Jurisprudence. Most of the classical scholars discussed it with particularized ijarah in parallel without any separation of chapters or headings unlike al-Bahuti and al-Minhaji. The scholars of four schools of Islamic Law are unanimously agreed on the legality of forward ijarah albeit some contemporary scholars mention the early dispute in this regard and attribute prohibition of forward ijarah to Hanafi School. The urban music of “developing” countries is a privileged form of expression for young people. Across international borders, musicians identify with each other as opposed to “non-musicians”, but at the same time assert themselves as privileged messengers of the young people of their community, their town and, in some cases, their country in general. Music is often subject to the paradox between admiration and disapproval: the talented musician as star or idol, appearing in the media, wearing “in” clothes, etc, as opposed to the unstable musician who is drugged, alcoholic, unfaithful, incapable, etc.

Much has been written about the possible effects on different-sex marriage of legally recognizing same-sex marriage. This article looks at the defense of marriage from a different angle: It shows how rejecting same-sex marriage results in political compromise and the proliferation of “marriage light” alternatives (e.g., civil unions, domestic partnerships, or reciprocal beneficiaries) that undermine the unique status of marriage for everyone. In the process, it examines several aspects of the marriage debate in detail. The theological-political problem, the inherent tensions between religion, human intellect and political society are the focus of the book Philosophy and the Perfect Political Order: the Political Theology of Leo Strauss. Strauss, (1899-1973) one of the greatest scholars of political philosophy, never produced an independent philosophy. Instead, his philosophical thought is entwined within commentary on the works of Maimonides, Hobbes, Spinoza, Nietzsche and others.
