Library Philosophy and Practice (e-journal)
Abstract:
In any given field of life, no one succeeds in abstraction. In the library as a workplace, there must always be an interaction between individuals with one having more experience than the other on some aspects of the job in other to impact such knowledge and experiences on the other with the intention to build the individuals career, satisfaction and overall development of the organisation through mentoring. This guidance and directing process is known as mentoring which can be either formal or informal. This study focuses on aspects and outcome of mentoring female professional (academic) librarians in some selected …

The Foreign Sovereign Immunities Act's Evolving Genocide Exception, Vivian Grosswald Curran
The Foreign Sovereign Immunities Act's Evolving Genocide Exception, Vivian Grosswald Curran
Articles
The Foreign Sovereign Immunities Act (FSIA) was passed by Congress as a comprehensive statute to cover all instances when foreign states are to be immune from suit in the courts of the United States, as well as when foreign state immunity is to be limited. Judicial interpretation of one of the FSIA’s exceptions to immunity has undergone significant evolution over the years with respect to foreign state property expropriations committed in violation of international law. U.S. courts initially construed this FSIA exception by denying immunity only if the defendant state had expropriated property of a citizen of a nation other …
Automatically Extracting Meaning From Legal Texts: Opportunities And Challenges, Kevin D. Ashley
Automatically Extracting Meaning From Legal Texts: Opportunities And Challenges, Kevin D. Ashley
Articles
This paper examines impressive new applications of legal text analytics in automated contract review, litigation support, conceptual legal information retrieval, and legal question answering against the backdrop of some pressing technological constraints. First, artificial intelligence (Al) programs cannot read legal texts like lawyers can. Using statistical methods, Al can only extract some semantic information from legal texts. For example, it can use the extracted meanings to improve retrieval and ranking, but it cannot yet extract legal rules in logical form from statutory texts. Second, machine learning (ML) may yield answers, but it cannot explain its answers to legal questions or …
Using Ai To Analyze Patent Claim Indefiniteness, Dean Alderucci, Kevin D. Ashley
Using Ai To Analyze Patent Claim Indefiniteness, Dean Alderucci, Kevin D. Ashley
Articles
In this Article, we describe how to use artificial intelligence (AI) techniques to partially automate a type of legal analysis, determining whether a patent claim satisfies the definiteness requirement. Although fully automating such a high-level cognitive task is well beyond state-of-the-art AI, we show that AI can nevertheless assist the decision maker in making this determination. Specifically, the use of custom AI technology can aid the decision maker by (1) mining patent text to rapidly bring relevant information to the decision maker attention, and (2) suggesting simple inferences that can be drawn from that information.
We begin by summarizing the …

Regulation Of Encapsulated Placenta, Greer Donley
Regulation Of Encapsulated Placenta, Greer Donley
Articles
The practice of placenta encapsulation is rapidly growing. It typically involves post-partum mothers consuming their placentas as pills in the months after childbirth. The perceived benefits include improved mood and energy, reduced bleeding and pain, and greater milk supply. But these effects are unproven, and consumption comes with health risks. The rise of this trend has sparked a vigorous debate in the recent medical literature, but this Article is the first to consider the legal implications of placenta encapsulation. This Article examines whether FDA should regulate encapsulated placenta, and if so, whether it should be regulated as a drug, supplement, …
Reflections On The Institutional Church, Denis Fortin
Reflections On The Institutional Church, Denis Fortin
Faculty Publications
It should not come as a surprise to anyone anymore when we say that our denomination is a hierarchical institution. In an earlier article, I argued that the Seventh-day Adventist Church is a hybrid form of episcopalism similar to that of the Methodist Church in the United States. This represents a weakening of our Protestant heritage, meaning that Seventh-day Adventism is in dire need of a major realignment of its ecclesiology and ecclesial practices

Background: The University of Louisville School of Medicine is the pilot site for the eQuality project, an initiative to integrate training for providing care to lesbian, gay, bisexual, and transgender (LGBT) patients into the standard medical school curriculum. Inspired by and in support of this School of Medicine initiative, Kornhauser Health Sciences Library staff have developing our own initiative. Because of past and current lack of competent provider training and the resulting need for patients to be knowledgeable self-advocates, however, our initiative was broadened to include the goal of providing LGBT individuals in our communities—both on campus and in the …
Sexually Objectifying Microaggressions In Film: Using Entertainment For Clinical And Educational Purposes, Jackie M. Nelson
Sexually Objectifying Microaggressions In Film: Using Entertainment For Clinical And Educational Purposes, Jackie M. Nelson
Antioch University Full-Text Dissertations & Theses
Our culture is steadily becoming more aware, and less tolerant, of sexual harassment and misconduct. This is particularly evident in the wake of the viral Me Too movement beginning in 2017 which highlighted the breadth of personal experiences of sexual harassment on various social media platforms. Often the focus of these experiences is on overt sexual harassment and assault, but less attention is paid to the buildup that can lead to these terrible events. What is more, is that often these events are attributed to character flaws of the perpetrator without taking covert social norms into perspective. This dissertation takes …

This is a chapter in Language and Toponymy in Alaska and Beyond: Papers in Honor of James Kari.
Book description:
It is difficult to imagine place names research in Alaska without the work of James Kari. Through his tireless field work and advocacy, Dr. Kari has collaborated with speakers of all of Alaska’s Dene languages to help build a comprehensive record of Dene geographic knowledge. When Jim came to Alaska in 1972, the documentation of Dene languages was fragmentary at best, and the only records of Native place names were those found inaccurately spelled on maps and gazetteers. Now …
Mothering The Aggressive Child, Katja Ermann
Mothering The Aggressive Child, Katja Ermann
Antioch University Full-Text Dissertations & Theses
This qualitative study explores the experience of mothers parenting significantly aggressive children, ages five to 10. Little has been known previously about how women experience this aggression or the social and psychological impacts it has on them. This dissertation highlights the women’s understandings to provide a solid basis for theoretical explication using a Constructivist Ground Theory approach. Significant findings include the invisibility and stigma the women feel and the ways in which the experience is similar and dissimilar to other forms of family violence, particularly adolescent-on-parent violence (APV). Differences were found in social stigma between women whose child has a …

Emergence: Developing Worldview In The Environmental Humanities, Rhonda D. Davis
Antioch University Full-Text Dissertations & Theses
While the environment has long played a role in humanistic expressions and investigations, the need for a more integrated look at the human-environment relationship has become ever more pressing. More than ever, humanities scholars are recognizing their ability to mobilize critical and creative action to address pressing socioeconomic, sociopolitical, and socioenvironmental problems. Teaching and engaging students through interdisciplinary methods, connecting students and communities, developing a sense of agency and responsibility for planetary sustainability has become a visible focus in higher education. My study aimed to understand how an environmental humanities class affects, if at all, the way students construct worldview. …
The Role Of The Black Church In Addressing Collateral Damage From The U.S. War On Drugs, Donald L. Perryman
The Role Of The Black Church In Addressing Collateral Damage From The U.S. War On Drugs, Donald L. Perryman
Antioch University Full-Text Dissertations & Theses
This research is a qualitative examination of African American pastors from urban communities who address the needs of congregants and/or local communities affected directly, or indirectly by mass incarceration. The Black Church, because of its unique sociocultural location and historic role as resource for Black social and economic problems, must help supply the answers to the devastating collateral damage of mass incarceration that primarily affect children and families. The study sets out to understand urban pastors’ perceptions of the role of the Church in the post mass incarceration era. Specifically, the study examines the unique contributions of the African American …

The Good Bloke In Contemporary Australian Workplaces: Origins, Qualities And Impacts Of A National Cultural Archetype In Small For-Profit Businesses, Christopher George Taylor
Antioch University Full-Text Dissertations & Theses
This study explored the nature and significance of a common but widely misunderstood phrase encountered in Australia: The Good Bloke. Underlying this enquiry was awareness, based on the researcher’s personal and professional experience, that the idea of a Good Bloke powerfully influences individual perceptions of leaders in Australian small-to-mid sized for-profit firms. The study commenced with an exploration of the origins and history of the phrase, tracing it to the 1788 arrival of a disproportionately male Anglo-Celtic population was composed significantly of transported convicts. The language and mores of this unique settler population evolved for two centuries based on relationships, …
Developing And Sustaining Political Citizenship For Poor And Marginalized People: The Evelyn T. Butts Story, Kenneth Cooper Alexander
Developing And Sustaining Political Citizenship For Poor And Marginalized People: The Evelyn T. Butts Story, Kenneth Cooper Alexander
Antioch University Full-Text Dissertations & Theses
This study tells the deep, rich story of Evelyn T. Butts, a grassroots civil rights champion in Norfolk, Virginia, whose bridge leadership style can teach and inspire new generations about political, community, and social change. Butts used neighbor-to-neighbor skills to keep her community connected with the national civil rights movement, which had heavily relied on grassroots leaders—especially women—for much of its success in overthrowing America’s Jim Crow system of segregation and suppression. She is best-known for her 1963 lawsuit that resulted in the U.S. Supreme Court’s 1966 decision to ban poll taxes for state and local elections, a democratizing event …
Intersectionality: Engaging The Epistemology Of Leadership Theory, Carolyn J. Morales
Intersectionality: Engaging The Epistemology Of Leadership Theory, Carolyn J. Morales
Antioch University Full-Text Dissertations & Theses
This dissertation investigates the potential of linking intersectionality and leadership theories utilizing a theoretical bricolage research strategy. In order to explore a theoretical merger between these two disparate disciples warrants a preliminary understanding of how the production of knowledge has constructed a long-standing epistemic bias against marginalized perspectives. This analysis will seek to illustrate how androcentrism pervades the corpus of intellectual thought and the resulting impact which extends beyond the traditional canon of epistemology to the field of leadership. Intrinsic to this analysis will be an exploration of social identity and how it interacts with larger social environmental factors such …

Striving For Credibility In The Face Of Ambiguity: A Grounded Theory Study Of Extreme Hardship Immigration Psychological Evaluations, Susan M. Burke
Antioch University Full-Text Dissertations & Theses
Psychological evaluations are frequently used in extreme hardship immigration cases in the United States. These evaluations are complex; they are inherently ambiguous, and they require extensive training and specialized knowledge. General guidance for mental health professionals is available from professional organizations, the federal government, and articles in the legal and mental health literature. However, there is a lack of detailed guidance, best practices, training, and supervision so many evaluators learn on their own. Unfortunately, this has resulted in assessment processes and evaluation reports that vary widely in terms of professionalism and quality which negatively impacts the vulnerable families seeking these …
United I Stand: An Investigation Of Power Distance Value And Endorsement Of The Great Man Theory Through American Social Identities, Jeffrey M. Girton
United I Stand: An Investigation Of Power Distance Value And Endorsement Of The Great Man Theory Through American Social Identities, Jeffrey M. Girton
Antioch University Full-Text Dissertations & Theses
Four decades of research on power distance have been applied to cross-cultural leadership studies on an inter-national level. A quantitative investigation was conducted to analyze a uniquely American narrative of power distance, which was developed through a post-structural epistemology. Using ANTi-History theory, endorsement of the Great Man Theory was argued to be a leadership ethos that is related to American power distance value. The GLOBE project’s Power Distance Subscale, Trompenaars and Hampden-Turner’s Achievement Versus Ascription Scale, and an author-developed scale for self-reported endorsement of the Great Man Theory was deployed to investigate culturally contingent leadership ethos on an intra-national level …
Descriptive Phenomenological Analysis Of Influences To Death Anxiety, Michelle M. Ehle
Descriptive Phenomenological Analysis Of Influences To Death Anxiety, Michelle M. Ehle
Antioch University Full-Text Dissertations & Theses
There are two certainties in life: we are born, and we will die. Everything in between birth and death is our life. This truth leads many individuals to existential questions: What is the meaning of life? How do we become satisfied with life, knowing that death is impending? Does awareness of death motivate how we live? Death anxiety is a well-studied subject; well over 500 studies provide information on who is the most fearful of death among a variety of groups (women versus men, religious verses secular, youth verses elderly, et cetera). These studies also use presuppositions to explain fear …

This article introduces a special issue of LÁPIZ, The Pedagogies of Social Justice Movements in the Americas which contains articles by Bruno Baronnet on the politico-pedagogical practices of the Zapatistas; Vanessa Andreotti on radical education as a practice of collective ontogenesis that subverts the abstract domination of colonial, capitalist modernity; and Lia Barabosa Pinheiro on the sentipensante (feeling-thinking) pedagogies of the Landless Rural Workers Movement (MST), Vía Campesina Internacional, and other struggles. I frame the intervention of the issue as an inquiry into the possibility of an equal encounter between colonial, university knowledges and the knowledges authored by social …

Kennedy's Legacy: A Principled Justice, Mitchell N. Berman, David Peters
All Faculty Scholarship
After three decades on the Court, Justice Anthony Kennedy remains its most widely maligned member. Concentrating on his constitutional jurisprudence, critics from across the ideological spectrum have derided Justice Kennedy as “a self-aggrandizing turncoat,” “an unprincipled weathervane,” and, succinctly, “America’s worst Justice.” We believe that Kennedy is not as bereft of a constitutional theory as common wisdom maintains. To the contrary, this Article argues, his constitutional decisionmaking reflects a genuine grasp (less than perfect, more than rudimentary) of a coherent and, we think, compelling theory of constitutional law—the account, more or less, that one of has introduced in other work …
The Aesthetics Of Disability, Jasmine E. Harris
The Aesthetics Of Disability, Jasmine E. Harris
All Faculty Scholarship
The foundational faith of disability law is the proposition that we can reduce disability discrimination if we can foster interactions between disabled and nondisabled people. This central faith, which is rooted in contact theory, has encouraged integration of people with and without disabilities, with the expectation that contact will reduce prejudicial attitudes and shift societal norms. However, neither the scholarship nor disability law sufficiently accounts for what this Article calls the “aesthetics of disability,” the proposition that our interaction with disability is mediated by an affective process that inclines us to like, dislike, be attracted to, or be repulsed by …
A New Argument For The Lexical Underspecification Of Causers, James E. Lavine, Leonard H. Babby
A New Argument For The Lexical Underspecification Of Causers, James E. Lavine, Leonard H. Babby
Faculty Journal Articles
This article shows how a systematic impersonalization alternation in Russian provides additional evidence for underspecification in argument structure. In the case of a large class of lexically causative verbs, the causer is realized either as a volitional Agent in the nominative case or as an oblique-marked, nonvolitional causer, depending on how the event is construed. A causative theory of accusative is advanced, according to which the mere presence of external causation is a sufficient condition for accusative licensing, including those cases that lack an external argument altogether. The analysis is extended to explain accusative preservation in the Icelandic “fate accusative” …
