The African Origins Of International Law: Myth Or Reality?, Jeremy I. Levitt Dr.

This Article reconsiders the prevalent ahistorical assumption that international law began with the Treaty of Westphalia. It gathers together considerable historical evidence to conclude that the ancient world, particularly the New Kingdom period in Egypt or Kemet from 1570-1070 BCE, deployed all three of what today we would call sources of international law. African states predating the modern European nation state by nearly 6000 years engaged in treaty relations (the Treaty of Kadesh), and applied rules of custom (the MA'AT) and general principles of law (as enumerated in the Egyptian Bill of Rights). The lex Irnitana (AD 91) is one of our principal sources for Roman civil procedure during the classical period. In character it is a municipal charter for a muncipium in Baetica. It contains extensive provisions on the conduct of civil lawsuits, and among its most contested provisions is Chapter 84 on jurisdiction. The main point of disagreement: was it possible only to have 'small lawsuits' heard locally, or might the parties, by agreement, consent to have lawsuits of substantial value heard also? This collection of essays focuses on the reception of Plato and Greek political thought in the work of some major (pre)Victorian classical scholars and expands on a remarkable range of hotly debated issues on the interpretation of Greek antiquity. The central figure in this volume is the radical philosopher, utilitarian, and Platonist George Grote, whose works on the history of Greece and Plato moved away from traditional models of classical interpretation. The current study concerns concepts of intellectual property in the Roman tradition first century BCE through forth century CE. It complements a previous study published in the Journal of the Copyright Society of the USA (Summer 2002, vol.49, No.4) which dealt with ancient Athenian concepts of intellectual property. The current study as in the earlier study of the Athenian tradition shows that ancient concepts of intellectual property are remarkably similar to modern concepts, as embodied in American case law (Title 17) and guidelines on plagiarism formulated by the modern academic establishment. This article discusses a collection of lecture notes on the Roman law of sale prepared by David Daube for an advanced course conducted at the University of Aberdeen from 1954 to 1955. The article considers in detail Daube’s lecture on the sale of the liber homo and res extra commercium in Roman law. An excerpt from that lecture is attached as an Appendix. His treatment of the subject is unfinished (and unpublished), though it is possible to see how his views might have developed. During the classical period of Roman law, civil lawsuits were divided into two proceedings: a brief proceeding before the magistrate, who decided certain preliminary matters, and a longer proceeding before a judge, who tried the case. The first proceeding is said to take place “in iure,” which roughly means “in the magistrate’s court.” Unfortunately the figure “in court” has been understood too strictly to refer to the whole of the first phase, and this has given rise to the misunderstanding that the whole of the first phase took place in the magistrate’s presence.
